Federal Court Actions Exception. The Parties agree that both the Xxxxxxx Xxxxxxxx et al. v. Attorney General of Canada proposed class action filed in the Federal Court on May 13, 2005 as Court File Number: T 848-05, and the Xxxxxx Xxxxxxxxx et al v. Attorney General of Canada proposed class action filed in the Federal Court on September 23, 2005 as Court File Number: T-1620-05, will be discontinued without costs on or before the Implementation Date.
