Common use of FEDERALLY REQUIRED PROVISIONS Clause in Contracts

FEDERALLY REQUIRED PROVISIONS. 9.2.1 If applicable, Contractor agrees to comply with all of the requirements set forth in Exhibit to this contract (“Exhibit 12-G Required Federal-Aid Contract Language,” including but not limited to form FHWA-1273), which is attached hereto and incorporated by this reference as though fully set forth herein. Contractor agrees to insert the substance of the provisions of this clause in all subcontracts issued pursuant to this contract. 9.2.2 If applicable, Contractor agrees to comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act, as amended (42 U.S.C. section 7401 et seq.) and the Federal Water Pollution Control Act, as amended (33 U.S.C section 1251 et seq.). 9.2.3 Contractor agrees to report each violation of the applicable standards, orders or regulations issued pursuant to the Clean Air Act, as amended (42 U.S.C. section 7401 et seq.) and the Federal Water Pollution Control Act, as amended (33 U.S.C section 1251 et seq.) to City and understands and agrees that City will, in turn, report each violation as required to assure notification to the Federal Emergency Management Agency (“FEMA”) and the appropriate Regional Office of the Environmental Protection Agency. 9.2.4 Contractor agrees to include the provisions set forth in sections 9.2.2 and 9.2.3 in each subcontract exceeding $150,000 financed in whole or in part with Federal assistance provided by FEMA.
