Fees, In General. 4.1.1.1 The City shall pay fees to the Architect/Engineer as specified in Article 4 for all services rendered by the Architect/Engineer in accordance with the terms and conditions of this Contract, but subject to Section 4.2 relating to appropriations made by the City. 4.1.1.2 If the Architect/Engineer receives payment from the City for work performed by any subcontractor or for materials provided by any supplier, and the Architect/Engineer withholds payment to the subcontractor or supplier on account of a deficiency in the quality or quantity of the work or materials, the City may withhold a corresponding amount from any pending or future payments to the Architect/Engineer until the next regular payment to the Architect/Engineer occurring after the City receives reasonable documentation that the deficiency has been remedied.
