Duties of the City. City shall make available to Consultant all data and information in the City's possession which City deems necessary to the preparation and execution of the work, and City shall actively aid and assist Consultant in obtaining such information from other agencies and individuals as necessary. The Director may authorize a staff person to serve as his or her representative for conferring with Consultant relative to Consultant's services. The work in progress hereunder shall be reviewed from time to time by City at the discretion of City or upon the request of Consultant. If the work is satisfactory, it will be approved. If the work is not satisfactory, City will inform Consultant of the changes or revisions necessary to secure approval.
Duties of the City. In consideration of the foregoing, the City agrees to perform the following tasks and activities to the extent required:
A. Provide the County Clerk all XXXXX Notices concerning City ballot issues in the manner required by the Code on or before September 25, 2023, by 4:30 p.m. Such XXXXX Notice shall include:
1. The election date, hours, ballot title, text, and the City’s local election office address and the City’s election office telephone numberThe election date, hours, ballot title, text, and local election office address and telephone number.
2. For proposed City tax or bonded debt increases, the estimated or actual total of City fiscal year spending for the current year and each of the past four years and the overall percentage and dollar change.
3. For the first full fiscal year of each proposed City tax increase, City estimates of the maximum dollar amount of each increase and of district fiscal year spending without the increase.
4. For proposed City bonded debt, its principal amount and maximum annual and total district repayment cost and the principal balance of total current City bonded debt and its maximum annual and remaining total City repayment cost.
5. Two summaries, up to five hundred (500) words each, one for and one against any ballot proposal, of written comments filed with the Designated Election Official. The summary shall neither mention names of persons or private groups nor make any endorsements of or resolutions against the proposal. Petition representatives following these rules shall write this summary for their petition. The Designated Election Official shall maintain and accurately summarize all other relevant written comments.

Duties of the City. 2.1 The City shall contract with the Department to provide information to the Department to enable the County Tax Assessor-Collector to identify flagged vehicle owners to determine which vehicle owners have an outstanding warrant from the City for failure to appear or failure to pay a fine on a complaint that involves a violation of a traffic law pursuant to the Act. The City will in all instances ensure that all provisions of the Act are adhered to as well as all other applicable laws of the State of Texas. The City shall consult and coordinate with the County Tax Assessor-Collector regarding the number of vehicles which it sends to the Department to be flagged at one time.
2.2 The City shall notify the County Tax Assessor-Collector when a traffic law matter is cleared regarding a person:
2.2.1 Against whom a judgment has been entered and who has paid the municipal court the full amount of the fine and court costs; or
2.2.2 Who has perfected an appeal of the case for which the arrest warrant was issued; or
2.2.3 Whose charge for which the arrest warrant was issued has been dismissed; or
2.2.4 Whose charge for which the arrest warrant was issued has been cleared through judicial action or clerical correction; or
2.2.5 Who has posted a bond and requested a hearing for the charge on which the arrest warrant was issued,
2.3 The City shall notify the Department pursuant to its agreement with the Department regarding a person:
2.3.1 Against whom a judgment has been entered and who has paid the municipal court the full amount of the fine and court costs; or
2.3.2 Who has perfected an appeal of the case for which the arrest warrant was issued; or
2.3.3 Whose charge for which the arrest warrant was issued has been dismissed; or
2.3.4 Whose charge for which the arrest warrant was issued has been cleared through judicial action or clerical correction; or
2.3.5 Who has posted a bond and requested a hearing for the charge on which the arrest warrant was issued.
2.4 The City shall provide necessary notice forms that a traffic law matter is cleared for presentation to the County Tax Assessor-Collector pursuant to Section 2.2 above on a form that is acceptable to the County.
2.5 The City shall provide to the County instruction sheets in a form acceptable to the County and maps for the County to distribute to flagged motor vehicle owners necessary to accomplish the purposes of this Agreement.

Duties of the City. The City shall authorize all actions and execute all documents necessary or desirable to loan up to $3,000,000 from the City’s General Fund to the Agency’s capital project funds as delineated in Section 5, and comply with the laws of the State of Oregon, including the terms and conditions contained within this Agreement. The Agency shall reimburse the City for its expenses incurred in the performance of this Agreement.

b. Tiger Splash shall not operate or allow the sale of concessions without City written approval, which shall be requested in advance of any sale, unless otherwise specifically authorized by this agreement.
c. The City will allow Tiger Splash to sell coffee and breakfast tacos on Swim Meet Days: May 22, May 29, June 5, June 19, and June 26.
d. The City will provide a pool cover.
e. The City will purchase 300 gallons of propane for the pool.
f. The City will provide a minimum of 2 lifeguards at every swim practice and meet.

b. Tiger Splash shall not operate or allow the sale of concessions without City written approval, which shall be requested in advance of any sale, unless otherwise specifically authorized by this agreement.
c. The City will allow Tiger Splash to sell coffee and breakfast tacos on Swim Meet Days: May 25, June 1, June 8, June 15, June 23, and June 29. Concessionaires may be required to obtain a food handlers permit and shall comply with the City’s Food Establishment Regulations (Chapter 10 Health and Sanitation, Article 10.02 Food Establishments, City of Dripping Springs Code of Ordinances).
d. Costs for heating the pool are covered by the facility rental fee.
e. A minimum of 2 lifeguards will be present at every swim practice (provided that junior aquatic volunteers are present in the water during practice) and a minimum of 3 lifeguards at every swim meet or swim team party.
f. The city will allow Tiger Splash to hang one (1) canvas banner on the inside of the fence facing the pool area at Founders Memorial Pool at no cost. The banner must include the City of Dripping Springs provided logo and the design must be pre-approved by the City Administrator or other designee.
Duties of the City. 2.2.1 If a building permit is required, the City will process an application for, and Contractor shall purchase the building permit before Date of Commencement of the Work.
2.2.2 The City will make available to Contractor a reproducible set of Drawings. Additional copies will be furnished, on Contractor's request, at the cost of reproduction.
Duties of the City. 1.01. The recitals are incorporated into this Agreement as if fully set out word for word.
1.02. The City shall use the Funds to pay the Authority for all vouchers received from the Authority for work performed or work to be performed on the Project as set forth and specified in Article 9.01 hereof. The Authority shall use such the Funds to pay for all work contained in contracts entered into by the Authority for the benefit of the City with respect to the Project.
1.03. The City shall execute such other documents and provide such other information, plans and specifications that may be reasonably required for completion of the Project.
Duties of the City. A. The City agrees to pay the Hearing Officer for the Hearing Officer's services at the rate specified in Article II, Section B above. The City shall pay the Hearing Officer within thirty (30) days after receipt of the Hearing Officer's invoice for services provided.
B. The City shall defend, indemnify and hold harmless the Hearing Officer from any and all claims, causes of action, lawsuits, damages, losses, or expenses, including attorney fees, arising out of or resulting from the decisions rendered by the Hearing Officer, provided that the Hearing Officer was acting in the performance of this Agreement and was not guilty of malfeasance, willful misconduct or bad faith.
Duties of the City. In consideration of the performance of the duties and obligations of HEDRA, the City hereby authorizes HEDRA to compensate and reimburse United Way for the costs incurred in order to carry out its duties and obligations pursuant to this Agreement, which total amount shall not exceed 10% of the funds disbursed to nonprofit businesses under the Hastings Non-Profit Relief Program, up to a maximum of $5,000.00.
