Common use of Filing of Patent Application Clause in Contracts

Filing of Patent Application. Within thirty (30) days of Sponsor receiving the Invention Notice, the Sponsor may send notice to UHN requiring UHN to cause filing of patent application(s) in respect of the Invention at Sponsor’s expense (in initial jurisdictions to be decided by the Parties) and Sponsor shall be further granted the “Option” further described in Section 7.4

Filing of Patent Application. Within thirty (30) days of Sponsor receiving the Invention Notice, the Sponsor may send written notice to UHN requiring notifying UHN of Sponsor’s intention to cause filing of seek patent application(s) protection for the invention described in respect of the Invention at Sponsor’s expense (in initial jurisdictions to be decided by the Parties) and Notice. Sponsor shall be further granted solely responsible for filing and prosecuting all patent applications relating to Inventions arising from the “Option” further described in Section 7.4Research Program. Sponsor shall be responsible for the cost of preparing, prosecuting, filing and maintaining any patent applications and patent arising from the Research Program.
