Common use of FINAL COMPLETION AND ACCEPTANCE Clause in Contracts

FINAL COMPLETION AND ACCEPTANCE. Within thirty one (31) days after the Company has given the City's Representative written notice that the work has been completed, or substantially completed, the City's Representative and the City shall inspect the work. If (a) the work is found completed or substantially completed in accordance with the contract documents, and (b) the Company has provided the City’s Representative a set of “as built” drawings, the City's Representative shall issue to the City and Company a certificate of completion. The work shall not be considered “completed” until such time as the certificate has been issued and no certificate shall be issued until the City has been given “as-built” drawings of the project by Company. Substantial Compliance will be defined as the stage in the progress of the Work where the Work or designated portion is sufficiently complete in accordance with the Contract Documents so that the City can occupy or utilize the Work for its intended use.
