Common use of Final Completion Countdown Notice Clause in Contracts

Final Completion Countdown Notice. (a) Project Co shall deliver a notice (the “Final Completion Countdown Notice”) to IO and the Independent Certifier specifying the date (which, for greater certainty, will be on or before the Scheduled Final Completion Date) on which Project Co anticipates that Final Completion will be achieved (the “Anticipated Final Completion Date”). (b) The Final Completion Countdown Notice shall be delivered not less than 90 days prior to the Anticipated Final Completion Date. If Project Co fails to deliver the Final Completion Countdown Notice not less than 90 days prior to the Scheduled Final Completion Date, the Anticipated Final Completion Date shall be deemed to be the same date as the Scheduled Final Completion Date.
