Common use of Financial Accountability Clause in Contracts

Financial Accountability. A. As provided in NMSA 1978, Section 11-1-4 (as amended), the Authority shall be strictly accountable for all receipts and disbursements, and shall maintain adequate, complete, and correct records and statements pertaining to receipts, disbursements, and all other financial matters. B. Each year, the Board shall cause an annual audit of the Authority’s finances to be performed in accordance with the New Mexico Audit Act, NMSA 1978, Sections 12-6-1 through 12-6-14, and implementing regulations; the audit shall be provided to each Party and shall be made available to the public. C. Upon reasonable notice, the records and statements prepared by the Authority shall be open to inspection at any reasonable time by the Parties, their accountants, and agents and Board directors and their alternates. D. The Authority shall prepare and present such reports as may be required by law, regulation, or contract to any governmental agency, and shall also render to the Parties, at reasonable intervals, such reports and accounting as the Parties may from time to time request.
