Common use of Firm Commitment Clause in Contracts

Firm Commitment. Xxxxxxx’s Nomination for the remainder of the gas day shall not exceed the lesser of: (a) the hours remaining in the gas day (identified in the nomination cycle timelines posted on Xxxxxxxx’s website and the nomination deadlines provided in Enerline), multiplied by: (A) the Hourly Injection Quantity if Shipper is nominating receipts into the Storage Account; or (B) the Hourly Withdrawal Quantity if Shipper is nominating deliveries from the Storage Account; and (b) whether Shipper is nominating receipts into or deliveries from the Storage Account, the Maximum Daily Withdrawal Demand plus any Authorized Overrun less any quantities that had been accepted by Xxxxxxxx as an Authorized Quantity (whether as receipts into or deliveries from the Storage Account) for any previous period of the gas day.
