Firm Service. All Firm service rendered under this Contract shall be provided to Shipper except in the case of force majeure as described in Bay Gas’ General Terms and Conditions attached as Exhibit “B”. Bay Gas shall not be obligated to provide capacities in excess of those stated in Section 3.1 of this Contract.
Firm Service. Service hereunder shall be firm and therefore not subject to load curtailment. Power interruptions may occur as the result of planned and Millennium Ethanol, LLC Electric Service Agreement coordinated maintenance and circumstances beyond the control of the Cooperative as provided for in Section 4,i. of this Agreement.
Firm Service. Services that are accorded the highest priority in the Processing Plant with respect to capacity allocations, interruptions, or curtailments, specifically including (i) the Services provided to Producer hereunder with respect to Producer’s Firm Capacity and (ii) services to any Person for which Processor is contractually obligated to give the highest priority.
Firm Service. (a) On any Day during the Service Term of the Firm Service, Service Provider will provide the Firm Service to User on and subject to the terms of this Agreement.
Firm Service. Fluid Handling Services that are accorded the highest priority on the Water Facilities with respect to capacity allocations, interruptions, or curtailments, specifically including the Fresh Water Services provided to Producer hereunder. Firm Services will be the last curtailed on the relevant part of the Water Facilities in the event of an interruption or curtailment, and all Firm Services will be treated equally in the event an allocation is necessary.
Firm Service. Foundation Shipper C A firm gas transportation service on DDP 90 provided pursuant to a Gas Transportation Agreement with Foundation Shipper C, including any such service acquired by a Foundation Trade Shipper through a Foundation Trade (DDP 90-2 Foundation Firm Services). In the event of insufficient available Capacity in the DDP 90 Pipeline to meet all DDP 90-2 Foundation Firm Services contracted by the Service Providers, the Service Providers will Curtail the quantities of Gas to be transported on account of the Shipper and all other shippers entitled to DDP 90-2 Foundation Firm Services (DDP 90-2 Shippers), and such Curtailment will be apportioned on a pro-rata basis according to the proportion that each DDP 90-2 Shipper’s Operational MDQ (to the extent related to DDP 90-2 Foundation Firm Services) is as a percentage of all Operational MDQ for DDP 90-2 Foundation Firm Services under all Gas Transportation Agreements at the relevant Receipt and/or Delivery Point, as applicable. 2 Firm Haulage Services (other than Foundation Firm Services) A gas transportation service on DDP 90 that gives the highest level assurance (subject to the services described at priorities 1 and 2) that the Shipper will be able to transport Gas, subject to Curtailment, including any such service acquired by a Secondary Shipper through an Exchange Trade or Bilateral Trade. In the event of insufficient available Capacity in the DDP 90 Pipeline to meet all Firm Haulage Services (other than 3 3440-4547-1244 Gas Transportation Agreement (DDP) 75 Service Priority number
Firm Service. The receipt, gathering, and delivery of Gas hereunder shall be on a “Firm” basis, which means that Shipper shall deliver such Gas to Gatherer, and Gatherer shall receive at the Receipt Points and deliver an Equivalent Quantity to the Reinjection Points or Delivery Points without interruption, suspension, or curtailment, at the fees set out herein. Notwithstanding the foregoing to the contrary, if either Party interrupts, suspends, or curtails the receipt, gathering, or delivery of Gas hereunder pursuant to applicable Laws or the orders of any court or other tribunal having jurisdiction, or due to conditions of Force Majeure, or upon the request of any Governmental Entity, or as may otherwise be permitted by the terms of this Agreement, then the interrupting Party shall incur no Liability of any kind or character to the other Party as a result of or with respect to such interruption, suspension, or curtailment.
Firm Service. Subject to the provisions of this Agreement, the electric service, rates and charges provided herein are for firm service, subject to emergency curtailments made on an equitable basis as to other firm customers of Seller. The parties will communicate and coordinate operations to the extent practical given the conditions then existing. Seller shall attempt to provide Customer with advance notice of any planned outages when practical and to restore service promptly in light of the circumstances then existing. Seller anticipates, but does not guaranty, Firm Service will be available to Customer no later than March 9, 2009.
Firm Service. Xxxxxxxx and Clean Energy have agreed to Firm Service. Xxxxxxxx will be obligated to sell to Clean Energy and Clean Energy shall be obligated to purchase from Xxxxxxxx the minimum number of Loads agreed to in Section 2.2 for the term of this LNG Agreement. Firm Service. (a) Addition of a Receipt Point Any firm Shipper receiving service under Part 284 of the Commission's regulations is entitled to use the receipt point specified in its service agreement as a primary receipt point. A firm Shipper may add a secondary receipt point at any time during the life of the contract provided that secondary receipt point is within the Shipper's Primary Path. Firm Shippers who are billed under a reservation charge and a delivery rate will continue to be billed reservation charges based on the primary receipt point while delivery rates, including fuel, will be calculated on the receipt point actually used. To the extent additional meter station capacity or other facilities are required to effect the receipt point change, GTN will construct the additional capacity consistent with Paragraph 18.5.
