(1) Where the buyer expressly or by implication makes known to the seller the particular purpose for which the goods are required so as to show that the buyer relies on the seller’s skill or judgment, and the goods are of a description which it is in the course of the seller’s business to supply (whether the seller be the manufacturer or not), there is an implied condition that the goods shall be reasonably fit for such purpose: Provided that in the case of a contract for the sale of a specified article under its patent or other trade name there is no implied condition as to its fitness for any particular purpose.’ Summary: A condition that a good sold will be fit for purpose will be implied into a contract for sale where: • The purchaser expressly or impliedly makes a “particular purpose” known to the seller; and • The purchaser relies on the seller’s skill or judgment to propose a good that would be fit for that purpose; where • The seller was aware – or ought to have been aware – the his/her judgement was being relied upon; where • The seller usually sells goods of that type in the ordinary course of their business. • “Whenever any purpose is stated … the seller must supply goods reasonably fit to enable the buyer to carry out his purpose in any normal way. But that can only be right if the purpose is stated with sufficient particularity to enable the seller to exercise his skill or judgment in making or selecting appropriate goods.” • ▇▇▇▇▇▇ required walking shoes that would accommodate her bunion.
