Fixed Price Work. (1) relating to milestones set out in the Agreement, the portion of the Fixed Price attributable to the milestones which the Owner has agreed have been completed on or before the last Calendar Day of the Invoice Period to which the Proper Invoice relates except for milestones dealt with in prior Proper Invoices; (2) not relating to milestones set out in the Agreement, the value, proportionate to the Fixed Price not attributable to the milestones, of such Fixed Price Work performed to the last Calendar Day of the Invoice Period to which the Proper Invoice relates less the value of such Fixed Price Work previously invoiced in prior Proper Invoices;

Fixed Price Work. Fixed Price Work means the portion of the Work paid for on a Fixed Price basis.
Fixed Price Work. Any estimate supplied by the company is subject to withdrawal at any time before receipt of an unqualified acceptance from the customer, and shall be deemed withdrawn unless it has been accepted within 30 days from its date.
Fixed Price Work. 2.1. 1The only allowable expense for Firm Fixed Price Work is the calendar monthly amount equal to [insert amount]. This amount represents full payment for all costs associated with the performance of Firm Fixed Price Work during an invoice period, including: 2.1.1. 1The full complement of Management and Support Staff as defined by the organization chart in Exhibit L. The cost for the agreed staffing levels includes the core staff of managers and supervisors, customer service representatives, purchasers, and various technical staff. The amount of the reduction will be equal to the product of the most current salary paid for the affected staff member multiplied by a percentage representing the portion of the minimum requirement that was unfilled. The AOC, upon request, has the right to review all supporting documents related to this report. 2.1.1. 2Total labor costs, overhead costs, operations and administrative costs in support of Firm Fixed Price Work. 2.1.1. 3All Subcontractor Material costs in support of Firm Fixed Price Work. 2.1.1. 4All Material costs in support of Firm Fixed Price Work. 2.1.1. 5Travel Expenses and Travel Time in the performance of Firm Fixed Price Work. 2.1. 2Adjustments. 2.1.2. 1Change to Facility List. 2.1.2.1. 1The AOC may (i) add a facility to the list of Facilities in Exhibit I, (ii) remove a facility from the list of Facilities in Exhibit I, or (iii) change the Contractor’s level of responsibility for a Facility. No such addition, removal, or change will require an Amendment. 2.1.2.1. 2If the AOC makes an addition, removal, or change as described above, the annual Firm Fixed Price payment will be adjusted pursuant to Table 2.1.2.1.2. The X-axis of the table shows the age of the facility added, removed, or changed, and the Y-axis shows the amount of square footage in the facility being added, removed, or changed. The amount of the adjustment will be equal to the total number of square feet added, removed, or changed multiplied by the appropriate price per square foot. If a facility is being added, the Firm Fixed Price will be increased as shown in Table 2.1.2.1.2. If a facility is being removed, the Firm Fixed Price will be decreased by the amount as shown in Table 2.1.2.1.2. Fixed Price Work. Fixed Price Work means the portion of the Work paid for on a Fixed Price basis. GC means the General Conditions.
Fixed Price Work. For Work performed on a fixed price basis, if Client gives S & B prompt written notice of a breach of warranty within a period of one (1) year after Client’s acceptance of the Work, S & B will promptly at its own expense re-perform and correct the services of the type originally performed by S & B which is found to be in breach of the warranty.
Fixed Price Work. For changes to fixed price Work, the price for any additional work or changes shall be determined as follows where feasible: 15.2.1 Client shall ask S & B to provide an estimated cost to perform Client’s desired change of scope on a fixed price basis. Client shall pay S & B for preparing all such estimates on a cost reimbursable basis using S & B’s current applicable rates in accordance with Attachment 4 of this Agreement 15.2.2 If the estimated cost for the change is approved by Client, such estimate shall be included in a revision indicating the original value plus the approved change and signed as approved by both parties. S & B shall then perform such change under the terms of this Agreement. 15.2.3 If S & B’s estimated cost is unacceptable to Client, the parties will negotiate and attempt to agree upon a mutually acceptable fixed price which, if agreed to, shall be signed and approved by both Parties and then performed by S & B as a Work revision subject to the terms of this Agreement.

Fixed Price Work. For invoices for fixed price Work, payment will either be according to Attachment 4 or each invoice will show the percentage of Work completed during the invoice period. Client shall pay S & B the scheduled payment or the percentage of the fixed price that is due which is equal to the percentage of Work completed less payments previously made.
Fixed Price Work. If the Work is on a fixed price basis, then for and in consideration of the Work to be rendered by S & B, Client agrees to timely pay S & B the fixed price amount stated therein in accordance with Section 6 below. Such fixed price does not include any cost items not included in the Scope of Services as defined in Attachment 2 of this Agreement. The fixed price may be adjusted by a mutually agreed upon revision.
Fixed Price Work. Contractor acknowledges that all Work performed under this Agreement, with the exception of T&M Consulting Services, is payable on a fixed price basis in accordance with the terms and conditions of this Agreement, including this Paragraph 5.0 and Paragraphs 8.0 (Prices and Fees) and 10.0 (Invoices and Payments). Notwithstanding anything herein to the contrary, Contractor must complete all Work required pursuant to this Agreement in order to complete and deliver to County the System Software. Contractor further acknowledges that the Specifications set forth in Exhibit B (Statement of Work) and the System Requirements listed in Xxxxxxxx X.0, X.0, X.0 and B.4 are functional Specifications, and that it is Contractor’s responsibility and risk to design, achieve and timely deliver the System Software.
