Fleet Equipment. It is agreed that the Employer may lease the equipment of a fleet owner; a fleet being defined as three (3) or more tractors and/or tractors and semitrailers provided the Employer assumes complete control and supervision of such equipment.

Fleet Equipment. H&E shall be satisfied, based on the Interim Financial Statements, that the Company and the Company Subsidiaries have fleet equipment having an aggregate original equipment cost of at least $70.0 million, which equipment shall be in good operating condition (subject to ordinary wear and tear, including to the extent out of service for immaterial periods of time) and suitable for rental by the Company and the Company Subsidiaries in the Ordinary Course of Business.
Fleet Equipment. H&E shall be satisfied, based on the Interim Financial Statements and the 2006 Audited Financial Statements, that Bxxxxxx has fleet equipment (excluding the Hitachi Fleet) having an aggregate original equipment cost of approximately at least $42,664,301, and Hitachi Fleet having an aggregate original equipment cost of approximately at least $21,829,671, which equipment shall be in good operating condition (subject to ordinary wear and tear, including to the extent out of service for immaterial periods of time) and suitable for rental by Bxxxxxx in the Ordinary Course of Business.
