FLOOD NOTIFICATION. Has Owner ever been notified by any City or County governmental agency, or is Owner aware that the Property has been flooded or may be prone to flooding? The terms“flooded” or “flooding” shall mean general and temporary conditions of partial or complete inundation of normally dry land areas and structures upon said areas from the overflow of lakes, ponds, streams, rivers, creeks, and any other inland waters. In order to fulfill Owner’s and Xxxxxx’s obligations of disclosure, if the Property has been flooded within the past five (5) years and that fact is known to Owner, Owner shall disclose the information. As provided in Oklahoma Landlord Tenant Act, Xxxxxx shall include the information prominently and in writing as part of any written rental agreements. Failure to provide this information may entitle a tenant who is a party to the rental agreement to sue Owner of the premises in a court of competent jurisdiction and to recover the personal property damages sustained by tenant from flooding of the premises.
