FMP Relief Event Clause Samples

FMP Relief Event. Notwithstanding any provision to the contrary in this Agreement, FMP shall not be in default or liable for any failure or delay in the performance of its obligations under this Agreement where such failure or delay is caused by the occurrence of a FMP Relief Event. During the Term, and for a period of 12 months after Termination, neither party shall solicit the services of any employee of the other party who has been engaged in the provision or receipt (as appropriate) of the Services and/ or Software Services or in the management of this Agreement.
