FOP REPRESENTATION. Section 4.1 Representative(s) of the FOP shall be admitted to the Employer’s facilities for the purpose of processing grievances or attending meetings as permitted herein. Upon arrival, the FOP representative shall identify himself/herself to the Employer or the Employer’s designee. Section 4.2 The Employer shall recognize two (2) employees, known as Bargaining Unit Chairman and Bargaining Unit Vice-Chairman, designated by the FOP, to act as FOP associates for the purposes of processing grievances in accordance with the Grievance Procedure. The Bargaining Unit Chairman and Bargaining Unit Vice-Chairman, or in their absence or inability to perform their function, designated alternates, shall be recognized as representatives, as provided herein. Section 4.3 The FOP shall provide to the Employer an official roster of its officers and associates which is to be kept current at all times and shall include the following: A. Name B. FOP office held No employee shall be recognized by the Employer as a FOP associate until the FOP has presented the Employer with written certification of that person’s selection. Section 4.4 The investigation or writing of grievances (alleged or filed) by the Bargaining Unit Chairman may be performed during working hours when such activity does not interfere with the performance of the Bargaining Unit Chairman’s assigned duties. The following are considered authorized representational activities which may be conducted during the Bargaining Unit Chairman’s work time when release of the Bargaining Unit Chairman will not unduly disrupt the operation of the Office: A. Preparation for and attendance at grievance and disciplinary hearings. The Bargaining Unit Chairman will be given a reasonable amount of time immediately prior to a hearing for preparation. B. Any other representational activity specifically authorized by this Agreement (such as Labor/Management meetings), or specifically authorized by the Employer or designee(s). C. A reasonable amount of paid time as determined by the Employer to consult with non-employee representatives of the FOP. After obtaining permission to engage in representational activities as provided for in this Section, the Bargaining Unit Chairman or alternate will notify the appropriate supervisor of his/her absence from his/her work assignment. Upon entering any work area other than his/her own work area, and prior to engaging in any representational activities provided for in this Section, the Bargaining Unit Chairman or alternate shall request permission from the appropriate supervisor of such work area, and shall identify the nature of the representational activity he/she is to perform. Section 4.5 The FOP agrees that no representative or associate of the FOP, either employee or non-employee of the Employer, shall interfere, interrupt, or disrupt the normal work duties of employees. Further, the FOP agrees not to conduct meetings (bargaining unit, lodge, or committee meetings) involving on-duty employees except to the extent specifically authorized by the Employer. Bargaining unit members shall not conduct FOP business (defined as fundraising activities, solicitation for memberships, or distribution of literature) on behalf of the FOP, during the work time of any involved employee. Unauthorized activities shall cease upon the demand of a supervisor, and any failure to cease unauthorized activities may subject the offending employee(s) to disciplinary action.

Section 4.4 The investigation or writing of grievances 4.4. Associates may spend no more than twenty (alleged or filed20) by the Bargaining Unit Chairman may be performed during working hours when such per work week administering the agreement. Such release time is non-cumulative. Such activity does shall not interfere with the performance of the Bargaining Unit Chairman’s associate's assigned duties. The following are considered authorized representational activities which may be conducted during the Bargaining Unit Chairman’s work time when release of the Bargaining Unit Chairman will not unduly disrupt the operation of the Office:

B) The representatives shall not conduct FOP business (defined as fundraising activitiesbe permitted reasonable time to investigate, solicitation for memberships, or distribution of literature) on behalf of the FOP, during the work time of any involved employee. Unauthorized activities shall cease upon the demand of a supervisorpresent, and any failure process formal grievances on the Employer's property without the loss of pay during their regular working hours, provided that in each and every instance where such time is required, only one representative is assigned to a grievance, and the length of time and the time period with in the working hours shall be agreed upon previously by the FOP representative and the supervisor and/or the Chief of Police. The representative shall make all reasonable efforts, however, to process all grievances during non-working hours.
C) The FOP employee official shall cease unauthorized activities may subject immediately upon request of the offending employee(s) Police Chief or Safety/Service Director or their designee.
Section 4.5 An FOP employee representative who is on duty during, and participates at, a scheduled meeting between the Employer and the FOP to disciplinary actionnegotiate a new collective bargaining agreement shall receive his regular pay for the regularly scheduled on-duty hours spent at the meeting and shall receive no additional compensation. An FOP employee representative who is off duty during, and participates at, a scheduled meeting between the Employer and the FOP to negotiate a new collective bargaining agreement shall receive no compensation for actual hours spent at the meeting.

FOP REPRESENTATION. Section 4.1 Representative(sA. Non-employee FOP representative (s) which shall normally consist of the FOP no more than two (2) persons, shall be admitted to the Employer’s 's facilities and sites for the purpose of investigating and processing grievances or attending meetings as permitted herein. Section 4.2 B. The Employer shall will recognize two four (24) employees, known as Bargaining Unit Chairman and Bargaining Unit Vice-Chairman, designated employees selected by the FOP, to act as FOP associates Representatives of the Bargaining Units for the purposes purpose of processing grievances at Steps of the Grievance Procedure or attending meetings as authorized herein.
C. The Local Representative shall confine his FOP activities to the investigation and processing of grievances and shall be permitted to attend grievance hearings, or other meetings, which have been authorized by the Employer or his representative (s) to be held during regular hours, without loss of regular pay or benefits.
D. Where grievance hearings, or other meetings, have been authorized by the Employer, or his representatives, to be held during regular duty hours of the aggrieved employee, the FOP Representative and the aggrieved party in accordance with attendance shall not suffer loss in regular pay or benefits. The FOP Representative shall be recognized by the Employer as the appropriate Representative at Step One of the Grievance Procedure. The Bargaining Unit Chairman and Bargaining Unit Vice-Chairman, or in their absence or inability to perform their function, designated alternates, shall be recognized as representatives, as provided herein.
Section 4.3 E. The FOP shall provide to the Employer an official roster of all its officers and associates its Representatives which is to be kept current at all times and shall include the following:

3. Home Telephone number
4. FOP office held No employee shall be recognized by Office held
5. Immediate Supervisor
F. The highest ranking FOP official in the Employer as a FOP associate until the FOP has presented the Employer with written certification of that person’s selection.

During such service in these posts, the above-duty employees except designated FOP officials shall continue their entitlement to the extent specifically authorized by the Employer. Bargaining unit members shall not conduct FOP business (defined wages, fringe benefits, seniority accrual and all other benefits allowed a member as fundraising activities, solicitation for memberships, or distribution of literature) on behalf of the FOP, during the work time of any involved employee. Unauthorized activities shall cease upon the demand of a supervisor, and any failure to cease unauthorized activities may subject the offending employee(s) to disciplinary actionthough they were at all times performing their job-related duties.
