If an agreement is not reached between the CMR and the Board on a Lump Sum or Unit Price Change Order prior to the beginning of the Work, the Board may exercise the option to direct the Change Order Work to proceed based on a Force Account in accordance with Section 3.4.7.3 and a Lump Sum Change Order will be issued to finalize this change. Refusal of the CMR to execute one of a Lump Sum, Unit Price, or Force Account Change Order and proceed promptly with the Work shall be a material breach of this Contract that may be sufficient cause to issue a declaration of default.
