Common use of Form, Denomination and Date of Warrants Clause in Contracts

Form, Denomination and Date of Warrants. Each of the Warrant Certificates: (a) will be issued in substantially the form of Exhibit "A" attached as a part hereof; (b) will be numbered, lettered or otherwise distinguished in such manner as the Company may determine with the approval of the Warrant Agent; and (c) will be dated as of the date of the authentication of the Warrant Certificate. To the extent not inconsistent with the terms of this Agreement, any of the Warrant Certificates may be issued with appropriate insertions, omissions, substitutions, variations and legends as may be required to comply with any state or federal law, rule or regulation, the rules of any securities market in which the Warrants are admitted to trading or to otherwise conform to general usage. All Warrant Certificates and the underlying Warrants will be otherwise substantially identical except as to denomination and as otherwise provided in this Agreement.
