Common use of FUEL/MOTIVE FORCE Clause in Contracts

FUEL/MOTIVE FORCE. Prior to the Effective Date of this Agreement, Seller provided to PacifiCorp a fuel or motive force plan acceptable to PacifiCorp in its reasonable discretion and attached hereto as Exhibit D-1, together with a certification from a Licensed Professional Engineer to PacifiCorp attached hereto as Exhibit D-2, certifying that the implementation of the fuel or motive force plan can reasonably be expected to provide fuel or motive force to the Facility for the duration of this Agreement adequate to generate power and energy in quantities necessary to deliver the Minimum Annual Delivery set forth by Seller in Section 4.
