FUNDING AND ENVIRONMENTAL APPROVAL CONSTRAINTS. The Parties acknowledge that VTA’s ability to act in accordance with this Agreement is constrained by external factors, including but not limited to: • The requirement for FTA to issue a Record of Decision (ROD) before VTA may take any actions regulated under the National Environmental Policy Act (NEPA); and • Completion of a Full Funding Grant Agreement (FFGA) between VTA and FTA, which is a necessary component of the project’s financial arrangements.
