Funding Reservation. Notwithstanding any other provision of this Agreement, Atlantic Richfield reserves, and this Agreement is without prejudice to, the right to assert and bring future Claims against the State Parties if, following the Effective Date, sufficient funds are not obtained by or made available to the Regional Board, regardless of cause, to enable it to satisfy its obligations for the performance and payment of Response Actions and Response Costs, as specified in this Agreement, and as a consequence of such inability, Atlantic Richfield is or may be ordered or otherwise required by EPA, another United States agency, a tribe, or a state to perform Response Actions or pay Response Costs in excess of its obligations under this Agreement. Likewise, the State Parties reserve, and this Agreement is without prejudice to, the right to assert and bring future Claims against Atlantic Richfield if, following the Effective Date, sufficient funds are not obtained by or made available to Atlantic Richfield, regardless of cause, to enable it to satisfy its obligations for the performance and payment of Response Actions and Response Costs, as specified in this Agreement, and as a consequence of such inability, the Regional Board is or may be ordered or otherwise required by EPA, another United States agency, a tribe, or a state to perform Response Actions or pay Response Costs in excess of its obligations under this Agreement.

  • Loop Reservations 2.21.3.1 For a Mechanized LMUSI, TWTC may reserve up to ten (10) loop facilities. For a Manual LMUSI, TWTC may reserve up to three (3) loop facilities.

  • FUNDING CONTINGENCY If Congress makes any change in law that will affect the amount of funds authorized to be paid under this Agreement, the affected provisions in this Agreement will be automatically revised to reflect such change in funding. Under no circumstance may a payment be made under this Agreement that is in excess of the amount authorized by law at the time such amount may be owed.

  • Funding Increases Before the Funder can make an allocation of additional funds to the HSP, the parties will:

  • Reservation Deposit Payment of a deposit secures your reservations. Dates are not held without a reservation deposit. The balance of your reservation fee is due no later than 21 business days prior to your requested reservations.
