The Funds Transfer System clause defines the procedures and mechanisms by which payments or transfers of funds are processed between parties under the agreement. Funds Transfer System. We shall be authorized to use any funds- transfer system that we, in our sole discretion, deem appropriate. You acknowledge that each funds- transfer system is governed by its own operating rules and regulations and you agree that each Payment Order shall be subject to the rules and regulations of the funds-transfer system through which it is transmitted, including all interbank compensation rules governing the settlement of claims for compensation or adjustments of errors between member banks. You further agree that the funds- transfer system selected by us in executing a Payment Order shall be considered your agent.
Funds Transfer System. You agree that Helm may use any means or routes which we in our sole discretion consider suitable to execute your funds transfers. Funds transfers to or from your Account will be governed by the rules of any funds transfer system through which the transfers are made, as amended from time to time, including, without limitation, Fedwire, and NACHA or any regional association. However, with respect to international remittance transfers, within the meaning given to such term in the Remittance Rule, to the extent of any inconsistencies between the above referenced rules and the provisions of the Remittance Rule, the provisions of Remittance Rule shall prevail. Notwithstanding anything to the contrary contained herein, the rights and obligations that apply to such transfers are set forth in the Remittance Rule and, as applicable, as set forth in Florida law.
Funds Transfer System. You acknowledge that any payment orders governed by this Agreement may be governed by the rules of any funds transfer system through which any payment order is made, including the Fedwire Funds Service, National Settlement Service, any other Federal Reserve payment system, NACHA, payment systems offered by The Clearing House, the Society for Worldwide Interbank Financial Telecommunications, or any other funds transfer system (each and collectively a “Funds Transfer System”). By submitting a funds transfer request, you agree to and accept any rule of such Funds Transfer System, to the extent applicable to any transaction. The beneficiary’s bank must be a member of the Funds Transfer System, or ultimately have a correspondent bank that is a member or participant of the Funds Transfer System, as applicable to the funds transfer request.
Funds Transfer System. Customer may designate in a Payment Order the particular funds-transfer system and the intermediary banks, if any, to be used by USCB in connection with the funds transfer. If USCB receives a Payment Order without designation of the specific funds-transfer system, USCB may use any funds-transfer system and communications system that USCB, in its sole discretion, deems appropriate, including but not limited to the Federal Reserve System and, if available, the SWIFT System. Notwithstanding Customer's designation, USCB may use any funds-transfer system or intermediary bank to execute a Payment Order without prior notification to Customer if USCB in good faith determines that it is not feasible to follow Customer's designation or that following it would unduly delay completion of the funds transfer. Each funds-transfer system is governed by its own operating rules and regulations that may apply to a Payment Order, including all interbank compensation rules governing the settlement of claims for compensation or adjustments of errors between member banks. Each funds-transfer and/or communication system selected by USCB in executing a Payment Order shall be considered the agent of Customer.
Funds Transfer System. Bank will determine the funds transfer system to be used when Bank makes each Transfer and the means by which each Transfer will be made.
Funds Transfer System. Although we generally process and implement Wire Transfers through Fedwire, we may use any Wire Transfer system that we deem reasonable under the circumstances. You agree to be bound by the rules of whichever Wire Transfer payment system that we may use. Incoming Wire Transfers. We will provisionally credit the amount of an incoming Wire Transfer to the Account specified in the incoming Wire Transfer. Provisional credit does not constitute acceptance by us of the incoming Wire Transfer transaction, and the credit for the incoming Wire Transfer will remain provisional on our system until we shall have received final payment of the funds transferred. We shall have no obligation to accept any incoming Wire Transfer to a closed Account or if the account number specified in the incoming Wire Transfer does not match the account number of any of your Accounts.
