Common use of FURNISHED PROPERTY Clause in Contracts

FURNISHED PROPERTY. (a) LOCKHEED XXXXXX may, by written authorization, provide to SELLER property owned by either LOCKHEED XXXXXX or its customer (Furnished Property). Furnished Property shall be used only for the performance of this Contract. (b) Title to Furnished Property shall remain in LOCKHEED XXXXXX or its customer. SELLER shall clearly mark (if not so marked) all Furnished Property to show its ownership. (c) Except for reasonable wear and tear, SELLER shall be responsible for, and shall promptly notify LOCKHEED XXXXXX of, any loss or damage to Furnished Property. Without additional charge, SELLER shall manage, maintain, and preserve Furnished Property in accordance with applicable law, the requirements of this Contract and good commercial practice. (d) At LOCKHEED XXXXXX'x request, and/or upon completion of this Contract, SELLER shall submit, in an acceptable form, inventory lists of Furnished Property and shall deliver or make such other disposal as may be directed by LOCKHEED XXXXXX. (e) The Government Property Clause contained in this Contract shall apply in lieu of paragraphs (a) through (d) above with respect to Government-furnished property, or property to which the Government may take title under this Contract.

(e) The Government SELLER shall have no lien over Furnished Property Clause contained in this Contract and shall apply in lieu ensure that no lower tier subcontractor at any level shall have or purport to have any lien over Furnished Property and SELLER shall procure that the exclusion of paragraphs (a) through (d) above any such lien is brought to the attention of all lower tier subcontractors and any other persons who might deal with respect Furnished Property or otherwise claim to Government-furnished property, or property to which the Government may take title under this Contracthave a lien over it.

SELLER shall clearly mark (if not so marked) all Furnished Property to show its ownership. (c) Except for reasonable wear and tear, SELLER shall be responsible for, and shall promptly notify LOCKHEED XXXXXX VETERANS TRADING COMPANY of, any loss or damage to Furnished Property. Without additional charge, SELLER shall manage, maintain, and preserve Furnished Property in accordance with applicable law, the requirements of this Contract and good commercial practice. (d) At LOCKHEED XXXXXX'x VETERANS TRADING COMPANY's request, and/or upon completion of this Contract, SELLER shall submit, in an acceptable form, inventory lists of Furnished Property and shall deliver or make such other disposal as may be directed by LOCKHEED XXXXXXVETERANS TRADING COMPANY. (e) The Government Property Clause contained in this Contract shall apply in lieu of paragraphs (a) through (d) above with respect to Government-furnished property, or other property to which the Government has title, or may take title under this Contract.
