Common use of Furniture and Inclusions Clause in Contracts

Furniture and Inclusions. (a) The Developer must undertake all reasonable efforts to ensure that on or before Practical Completion the Building is fitted out so as to include the Inclusions and the Furniture. (b) Subject to clause 3(c), the Buyer acknowledges and agrees that at any time prior to Completion the Developer may, in its discretion substitute "like for like" items with respect to the Furniture and/ or Inclusions provided that they are not of any lesser quality than any of the items listed in the Schedule of Furniture and Inclusions. (c) The Developer acknowledges and agrees that it may only exercise its rights under clause 3(b) where, acting reasonably, it determines that a particular item is no longer available or the cost of that item has unreasonably increased.
