Common use of Further Adjustment Clause in Contracts

Further Adjustment. In the event the average occupancy level of the Building for the Base Services Year and/or any subsequent Lease Year was not 90 percent or more of full occupancy, then the Actual Costs for such year shall be proportionately adjusted by Landlord to reflect those costs which would have occurred had the Building been 90 percent occupied during such year.

Further Adjustment. In the event the average occupancy level of the Building for the Base Services Year and/or any subsequent Lease Year was or is not 90 percent 90% or more of full occupancy, then the Actual Costs for such year shall be proportionately adjusted by Landlord to reflect those costs which would have occurred had the Building been 90 percent 90% occupied during such year.

Further Adjustment. In the event the average occupancy level of the Building for the Base Services Year and/or any subsequent Lease Calendar Year was not 90 ninety-five percent (95%) or more of full occupancy, occupancy then the Actual Costs for such year shall be proportionately adjusted allocated among the tenants by the Landlord to reflect those costs which would have occurred had the Building been 90 ninety-five percent (95%) occupied during such year.

In the event the average occupancy level of the Building for the Base Services Year and/or any subsequent Lease Year was not 90 ninety-five percent (95%) or more of full occupancy, then the Actual Costs for such year shall be proportionately adjusted and apportioned among the tenants by Landlord to reflect those costs which would have occurred had the Building been 90 ninety-five percent (95%) occupied during such year.

Further Adjustment. In the event the average occupancy level ------------------ of the Building for the Base Services Year and/or any subsequent Lease Year was not 90 ninety five percent (95%) or more of full occupancy, then the portion of the Actual Costs for such year which are dependent upon and vary according to the level of occupancy of the Building shall be proportionately adjusted and apportioned among the tenants by Landlord to reflect those variable costs which would have occurred had the Building been 90 ninety five percent (95%) occupied during such year.
