FWS-Initiated Adaptive Management Sample Clauses

The FWS-Initiated Adaptive Management clause grants the U.S. Fish and Wildlife Service (FWS) the authority to modify project operations or management strategies in response to new information or changing environmental conditions. In practice, this means that if monitoring reveals unexpected impacts on wildlife or habitats, the FWS can require adjustments to minimize harm or achieve conservation goals. This clause ensures that projects remain flexible and responsive, allowing for proactive management to address uncertainties and protect natural resources effectively.
FWS-Initiated Adaptive Management. If FWS determines that one or more of the adaptive management provisions in the HCP have been triggered and that Permittee has not changed its management practices in accordance with Chapter 6 of the HCP, FWS will notify Permittee and will direct Permittee to make the required changes. Permittee will report to FWS on its actions or intended actions within thirty (30) days after receiving notice from the FWS and shall make the required changes in the period of time necessary to implement the changes, as agreed to by FWS and the Permittee. These changes are provided for in the HCP and hence do not constitute Unforeseen Circumstances or require amendment of the ITP or HCP.
FWS-Initiated Adaptive Management. If the FWS determines that one or more of the adaptive management provisions in the HCP have been triggered and that Permittee has not changed its management practices in accordance with section 4.5 of the HCP, the FWS shall notify Permittee and specifically identify the adaptive management measure(s) that the FWS deems appropriate. The Permittee will then have 30 days to respond to the notice, and if Permittee does not concur with the FWS, the FWS and Permittee will confer to develop a mutually agreeable solution. Within 30 days after the meet and confer, Permittee will make the required changes and report to the FWS that initiated the adaptive management on its actions. Such changes are provided for in the HCP, and hence do not constitute Unforeseen Circumstances or require amendment of the Permit or HCP, except as provided in this section.
