GENERAL COMPLIANCE WITH RESPECT TO THE UNIT. 16.1 Subject to Para 12 above, the Allottee shall, after taking possession, be solely responsible to maintain the Unit, at his/ her own cost, in good repair and condition including periodic painting of the exterior on all sides. It shall be the responsibility of the allottee to maintain his Complex in a proper manner and take all due care needed including but not limiting to the joints in the tiles in his unit are regularly filled with white cement/ epoxy to prevent water seepage and shall not do or suffer to be done anything in or to the building, or the Unit or the staircases, lifts, common passages, corridors, circulation areas, atrium or the compound which may be in violation of any laws or rules of any authority or change or alter or make additions to the Unit and keep the Unit , its walls and partitions, sewers, drains, pipe and appurtenances thereto or belonging thereto, in good and tenantable repair and maintain the same in a fit and proper condition and ensure that the support, shelter etc. of the Building is not in any way damaged or jeopardized and shall not cause any change to the colour, design of the elevation /exterior. 16.2 The Allottee further undertakes, assures and guarantees that he/ she would not put any sign board/ name-plate, neon light, publicity material or advertisement material etc on the face/ façade of the Building or anywhere on the exterior of the project, building therein or common areas. The Allottees shall also not change the colour scheme of the outer walls or painting of the exterior side of the doors/windows or carry out any change in the Lobby/exterior elevation or design. Further the Allottee shall not store any hazardous or combustible goods in the Unit, or place any heavy material in the common passages or staircase of the building. The Allottee shall also not remove any wall, including the outer and load bearing wall of the Unit, . 16.3 It is agreed recorded that the Promoter shall have exclusive right to place Hoarding, Neon Sign on the stair head room and Lift Machine room and in other Common areas/walls and exteriors 16.4 The Allottee shall plan and distribute its electrical load in conformity with the electrical systems installed by the promoter and thereafter the association of allottees and/ or maintenance agency appointed by association of allottees. The Allottee shall be responsible for any loss or damage arising out of breach of any aforesaid conditions. Periodic test of Electrical installations including wiring and also by Chartered Engineer shall be carried out at interval of every 2 years and also after possession and at the time of possession by the Maintenance In Charge/Association for ensuring safety and this is very much mandatory keeping the safety of the Complex as a whole in mind.

16.4 15.3 The Allottee shall plan and distribute its electrical load in conformity with the electrical systems installed by the promoter Promoter and thereafter the association of allottees and/ or and/or maintenance agency appointed by association of allottees. The Allottee shall be responsible for any loss or damage damages arising out of breach of any aforesaid of the previously mentioned conditions.
15.4 That the Allottee shall not use or allow using the unit for any non-‐residential purpose or any activity that may cause nuisance to other owners/occupants in the building/project. Periodic test The unit shall be intended for personal use as residence by such person. The Allottee further agrees that he shall not store any goods of Electrical installations including wiring hazardous or combustible nature or prohibited goods and/or which can cause damage to the construction or structure of the building.
15.5 The Allottee further agrees that he shall not display any name, address, signboard and/or advertisement material on the external façade of the structure except the name of the unit owner as per the signage guidelines provided by the PROMOTERS.
15.6 THE Allottee shall not at any time demolish or cause to demolish his unit or any part thereof, nor shall at any time make or cause to be made, any additions or alterations of whatsoever nature to the said unit or any part thereof, or any alterations in the elevation/ arcade, closing/ covering of the verandah or lounge or balconies change the outside color scheme of the said unit/building and also by Chartered Engineer shall keep the partition walls, sewers, drains, pipes in the said premises and appurtenances thereto, in good tenantable repairs and conditions and shall not chisel or in any manner damage the columns beams walls, stalls, RCC Pardis, carry out retaining walls or other structural alterations in the said unit.
15.7 AFTER the possession of the premises is handed over to the Allottee, any additions or alterations in or about or relating to the said Unit shall be carried out by the Allottee in co-‐operation with the Allottees of the other units in the said township at interval his own costs and the ‘PROMOTERS’ shall not in any manner be liable or responsible for the same and for any damage caused to the bungalow. No such work shall be carried out without the permission of every 2 years the concerned competent authority and also after possession adjoining unit holders.
15.8 THE Allottee shall not to throw dirt, rubbish, rags, garbage or other refuse or permit the same to be thrown from the said unit in compound or any portion of the said land or project land and shall abide by rules set out by local authority for garbage disposal.
15.9 After the execution of the sale deed, the insurance of the Bungalow/ Unit shall be the sole discretion and at the time expense of possession the unit owner/s. THE Allottee shall not do or permit any act or thing which render any insurance of the said property and the adjoining units void or voidable or any part thereof or whereby any increase in premium shall become payable in respect of the insurance by the Maintenance In Chargeother unit holders in the township.
15.10 That the Allottee has understood that the common amenities like gardens, common roads, drainage, sewers, water pipe lines, street light, LPG Gas supply systems if any Borewell, etc., shall be the common property and shall be available for common use by all the Allottee/Association s of the units in the said project. The Allottees of the units in the said project and the different common organization will have unrestricted right of way in common spaces, gardens, roads and in project for ensuring safety laying of pipelines, telephone and electric cables, sewerage and drainage line etc.
15.11 THE Allottee shall use community spaces, services in the project as per stipulated terms, condition, rules and regulations framed for the purpose by the ‘PROMOTERS’ or maintenance society/Company. The Green Lawns, gardens shall not be permitted to be used for conducting personal functions like marriage, parties etc.
15.12 THE Allottee shall from the date of Possession/ Deemed possession maintain the said unit and carry out all internal up keep & repairs therein, at its own cost, so as to keep the said unit in good tenantable state and condition and shall not do or suffer to be done anything, in or to the neighboring areas or any part of the township or the project, staircase or common passage, infrastructure facilities/amenities, which may be against the rules, regulations and byelaws of the society/Company/ Ananda Township or concerned local authority and/or public authorities and/or the ‘PROMOTERS’.
15.13 The Allottee hereby agrees to abide by all the terms & conditions of the application for allotment and this is very much mandatory keeping letter of Allotment and the safety applicable laws and to indemnify and to keep indemnified ‘PROMOTERS’ for any such act that result in the loss owing to any contravention or non-‐compliance of any of the Complex provisions of the application for allotment and this agreement.
15.14 THE Allottee shall take electricity and water connections from the various agencies in this respect. The ‘PROMOTERS’ will provide all necessary co-‐ordination in availing such permanent electricity connection and till the time the permanent electricity connection shall be issued by the MPKVV Co. ltd. or other concern authority, Allottee agrees to avail electricity facility through temporary connection from concern electricity providing company or ‘PROMOTERS’. It is further agreed that the Allottee shall pay all such charges, Fees, penalties & interest for such electricity connection, as a whole may be levied by the authority giving the connection. Charges are detailed as per Clause 1 of this Agreement.
15.15 The Allottee or the society/company/body formed by the Allottee shall not object or place any hindrance to the other Row House owners.
15.16 ALL charges including proportionate charges payable to various department for obtaining service connections to the said unit like electricity, telephone, piped gas, Narmada water etc, including security deposits for sanction and release of such connection as well as informal charges pertaining thereto will be payable by the applicant in mindaddition to the price of the said unit.

16.4 22.3 The Allottee Lessee shall plan and distribute its electrical load in conformity with the electrical systems installed by the promoter and thereafter the association of allottees and/ or maintenance agency appointed by association of allotteesNBCC. The Allottee Lessee shall be responsible for any loss or damage damages arising out of breach of any of the aforesaid conditions.
22.4 The Lessee shall not make any structural additions/alterations in the Unit or in any other part of the Project without the prior written consent of NBCC/RLDA and the Competent Authority.
22.5 The Lessee shall be solely responsible and liable for all deviations, violations of any of the conditions or rules or bye laws of local, State or Central Government and Competent Authority and shall be responsible for structural, fire and other safety measures at all times after handing over of the Unit to the Lessee by RLDA. Periodic test The Lessee shall also be solely responsible for any damage to the Building, the Unit or fixtures, in either the Common Areas or spaces acquired by other lessees, caused either by itself or by any third party using the Unit or the Common Areas on behalf of Electrical the Lessee.
22.6 The Lessee agrees that it shall use and permit usage of the Unit only for the purpose which is permissible under applicable laws and shall not use the Unit for any purpose which may or is likely to be a cause of nuisance or annoyance to occupants of other units in the Project or for any illegal or immoral purpose (“Permitted Use”). In the event of violation of the aforesaid, the Lessee shall be solely responsible and liable for all damages/liabilities that arise including penalties from local authorities/Central or State Government, if any. Additionally, the Lessee shall obtain all requisite licenses, permits, permissions, approvals, sanctions, registrations from the authorities concerned from time to time, as required for the running and operation of its business and the Permitted Use. Any fit-outs, installations including wiring within the Unit shall be subject to the approved plans, maps and also by Chartered Engineer shall be at the sole cost and expense of the Lessee. (iii) The Allottees Allottee(s) shall also not change the colour color scheme of the outer walls wall or painting of the exterior side of the doors/windows or carry out any change in the Lobby/exterior elevation or design. .
(iv) Further the Allottee Allottee(s) shall not store any hazardous or combustible goods in the Unit, Unit or place any heavy material in the common passages or staircase of the buildingBuilding. The Allottee Allottee(s) shall also not remove any wall, including the outer and load bearing wall of the Unit, .
16.3 (v) That all fixture and fitting including but limited to air conditioners, coolers etc. shall be installed by the Allottee(s) at place earmarked or approved by the Promoter/ Owners Association and nowhere else. The non-observance of the provisions of this clause shall entitle the Promoter or Owners Association, as the case may be, to enter the Unit, if necessary and remove all non-conforming fittings & fixtures at the cost and expenses of the Allottee(s).
(vi) The Allottee(s) agrees to abide by and comply with the bye-laws or housing rules or such rules which may be issued from time to time by the Owners Association in the interest of the upkeep, cleanliness, security, etiquettes and maintenance of the Said Project/Whole Project.
(vii) The Allottee(s) shall not raise any construction whether temporary or permanent on the rear/front balcony/ lawns /roof-top/ terrace under his/her/its use.
(viii) It is agreed recorded that in the Promoter interest of the Allottee(s), to help the Owners Association in effectively keeping the Unit and/or the Said Project/Whole Project secured in all ways, For the purpose of security, the Owners Association would be free to restrict and regulate the entry of visitors into the Building/ Said Project/Whole Project.
(ix) The Allottee(s) shall have exclusive right not use the Unit for any purpose other than as set out under this Agreement nor use the same for any purpose which may or is likely to place Hoardingcause nuisance or annoyance to occupiers of the premises in the Said Project/Whole Project or for any illegal or immoral purpose.
(x) Allottee(s) shall not throw dirt, Neon Sign on rubbish, rags, garage etc. or permit the stair head room same to be thrown from the Unit in the compound or any portion of the Scheduled Land and Lift Machine room the Building in which the Unit is situated.
(xi) Allottee(s) shall not do or permit to be done any act or thing which may render void or voidable any insurance of the Unit and the Building/Said Project/Whole Project in which the Unit is situated or lead to increase in insurance premium payable in respect of the insurance of the said Building/Said Project/Whole Project and/or the Unit.
(xii) Allottee(s) shall not damage in any manner, the columns, beams, walls, slabs or R.C.C. paradise or other Common areas/walls structures in the Unit. The Allottee(s) shall also not remove any wall, including the outer and exteriorsload wall of the Unit.

16.2 (ii) The Allottee Allottee(s) further undertakes, assures and guarantees gurantees that he/ she would not put any sign sign-board/ name-plate, neon light, publicity material or advertisement material etc etc. on the face/ façade of the Building or anywhere on the exterior of the projectSaid Project/Whole Project, building therein or common areas. .
(iii) The Allottees Allottee(s) shall also not change the colour color scheme of the outer walls wall or painting of the exterior side of the doors/windows or carry out any change in the Lobby/exterior elevation or design. .
(iv) Further the Allottee Allottee(s) shall not store any hazardous or combustible goods in the Unit, Unit or place any heavy material in the common passages or staircase of the buildingBuilding. The Allottee Allottee(s) shall also not remove any wall, including the outer and load bearing wall of the Unit, .
16.3 (v) That all fixture and fitting including but limited to air conditioners, coolers etc. shall be installed by the Allottee(s) at place earmarked or approved by the Promoter/ Owners Association and nowhere else. The non-observance of the provisions of this clause shall entitle the Promoter or Owners Association, as the case may be, to enter the Unit, if necessary and remove all non-conforming fittings & fixtures at the cost and expenses of the Allottee(s).
(vi) The Allottee(s) agrees to abide by and comply with the bye-laws or housing rules or such rules which may be issued from time to time by the Owners Association in the interest of the upkeep, cleanliness, security, etiquettes and maintenance of the Said Project/Whole Project.
(vii) The Allottee(s) shall not raise any construction whether temporary or permanent on the rear/front balcony/ lawns /roof-top/ terrace under his/her/its use.
(viii) It is agreed recorded that in the Promoter interest of the Allottee(s), to help the Owners Association in effectively keeping the Unit and/or the Said Project/Whole Project secured in all ways, For the purpose of security, the Owners Association would be free to restrict and regulate the entry of visitors into the Building/ Said Project/Whole Project.
(ix) The Allottee(s) shall have exclusive right not use the Unit for any purpose other than as set out under this Agreement nor use the same for any purpose which may or is likely to place Hoardingcause nuisance or annoyance to occupiers of the premises in the Said Project/Whole Project or for any illegal or immoral purpose.
(x) Allottee(s) shall not throw dirt, Neon Sign on rubbish, rags, garage etc. or permit the stair head room same to be thrown from the Unit in the compound or any portion of the Scheduled Land and Lift Machine room the Building in which the Unit is situated.
(xi) Allottee(s) shall not do or permit to be done any act or thing which may render void or voidable any insurance of the Unit and the Building/Said Project/Whole Project in which the Unit is situated or lead to increase in insurance premium payable in respect of the insurance of the said Building/Said Project/Whole Project and/or the Unit.
(xii) Allottee(s) shall not damage in any manner, the columns, beams, walls, slabs or R.C.C. paradise or other Common areas/walls structures in the Unit. The Allottee(s) shall also not remove any wall, including the outer and exteriorsload wall of the Unit.
16.4 (xiii) The Allottee Allottee(s) shall plan and distribute its electrical electric load in conformity with the electrical electric systems installed by the promoter Promoter and thereafter the association of allottees and/ or Owners Association and/or maintenance agency appointed by association of allotteesthe Owners Association. The unit shall be intended for personal use as residence by such person. Periodic test The Allottee further agrees that he shall not store any goods of Electrical installations including wiring hazardous or combustible nature or prohibited goods and/ or which can cause damage to the construction or structure of the building.
15.5 The Allottee further agrees that he shall not display any name, address, signboard and/ or advertisement material on the external façade of the structure except the name of the unit owner as per the signage guidelines provided by the PROMOT ERS.
15.6 THE Allottee shall not at any time demolish or cause to demolish his unit or any part thereof, nor shall at any time make or cause to be made, any additions or alterations of whatsoever nature to the said unit or any part thereof, or any alterations i n the elevation/ arcade, closing/ covering of the verandah or lounge or balconies change the outside color scheme of the said unit/ building and also by Chartered Engineer shall keep the partition walls, sewers, drains, pipes in the said premises and appurtenances thereto, in good tenantable repairs and conditions and shall not chisel or in any manner damage the columns, beams, walls, common wall, or other structural alterations in the said unit.
15.7 AFTER the possession of the premises is handed over to the Allottee, any additions or alt erations in or about or relating to the said unit shall be carried out by the Allottee in co-operation with the Allottees of the other units in the said township at interval his own costs and the ‘PROMOTERS’ shall not in any manner be liable or responsible for the same and for any damage caused to the unit. No such work shall be carried out without the permission of every 2 years the concerned competent authority and also after possession adjoining unit holders.
15.8 THE Allottee shall not to throw dirt, rubbish, rags, garbage or other refuse or permit the same to be thrown from the said unit in compound or any portion of the said land or project land.
15.9 After the execution of the sale deed, the insurance of the Unit shall be the sole discretion and at the time expense of possession the unit owner/ s. THE Allottee shall not do or permit any act or thing which render any insurance of the said property and the adjoining units void or voidable or any part thereof or whereby any increase in premium shall become payable in respect of the insurance by the Maintenance In Charge/Association other unit holders in the township.
15.10 That the Allottee has understood that the common amenities like gardens, common roads, lifts, lobbies, stairs, drainage, sewers, water pipe lines, street light, LPG Gas s upply systems if any Borewell, etc., shall be the common property and shall be available for ensuring safety common use by all the Allottee/ s of the units in the said project. The Allottees of the units in the said project and the different common organization will have unrestricted right of way in common spaces, gardens, roads and in project for laying of pipelines, telephone and electric cables, sewerage and drainage line etc.
15.11 THE Allottee shall use community spaces, services in the project as per stipulated terms, condition, rules and regulations framed for the purpose by the ‘PROMOTERS’ or maintenance society/ Company. The Green Lawns, gardens shall not be permitted to be used for conducting personal functions like marriage, parties etc.
15.12 THE Allottee shall from the date of Possession/ Deemed possession maintain the said unit and carry out all internal up keep & repairs therein, at its own cost, so as to keep the said unit in good tenantable state and condition and shall not do or suffer to be done anything, in or to the neighboring areas or any part of the township or the project, staircase or common passage, infrastructure facilities/ amenities, which may be against the rules, regulations and byelaws of the society/ Company or concerned local authority and/ or public authorities and/ or the ‘PROMOTERS’.
15.13 The Allottee hereby agrees to abide by all t he terms & conditions of the application for allotment and this is very much mandatory keeping letter of Allotment and the safety applicable laws and to indemnify and to keep indemnified ‘PROMOTERS’ for any such act that result in the loss owing to any contravention or non -compliance of any of the Complex provisions of the application for allotment and this agreement.
15.14 The Allottee or the society/ company/ body formed by the Allottee shall not object or place any hindrance to the other unit owners.
15.15 ALL charges including proportionate charges payable to va rious department for obtaining service connections to the said unit like telephone, piped gas, Narmada water etc, including security deposits for sanction and release of such connection as a whole well as informal charges pertaining thereto will be payable by the applicant in mindaddition to the price of the said unit.

(xvii) After handing over of the Said Project, the Allottee shall be responsible to pay to the Association and/or Maintenance Agency towards security/deposit/ recurring infrastructure charges / to be paid to the government agencies towards electricity, water charges (including but not limited to abstraction charges) and infrastructure charges or any other charges or deposit/security required to be paid with respect to the Said Project/Whole Project
(xviii) Pay to the Promoter within fifteen days of demand by the Promoter, his share of security deposit demanded by the concerned local authority or Government for giving water, electricity or any other service connection to the building in which the Apartment is situated.
(xix) Not to install any dish or other antennae for reception of radio, telecom or television signals in such manner in the Apartment whereby such dish or other antennae projects outside the Unit or on any part of the exterior of the Project or any of the common areas thereof, including on the terrace thereof.
(xx) To bear and pay increase in local taxes. water charges, insurance and such other levies, if any, which are imposed by the concerned local authority and/or Government and/or other public authority, on account of change of user of the Apartment by the Allottee to any purposes other than for purpose for which it is sold.
(xxi) The Allottee shall not let, sub-let, transfer, assign or part with interest or benefit factor of this Agreement or part with the possession of the Apartment until all the dues payable by the Allottee to the Promoter under this Agreement are fully paid up and only if the Allottee had not been guilty of breach of or non-observance of any of the terms and conditions of this Agreement and until the Allottee has intimated in writing to the Promoter and obtained the written consent of the Promoter for such transfer, assign or part with the interest etc.
(xxii) The Allottee shall observe and perform all the rules and regulations which the Society or the Limited Company or Apex Body or Federation may adopt at interval its inception and the additions, alterations or amendments thereof that may be made from time to time for protection and maintenance of every 2 years the said building and also after possession the Apartments therein and at for the observance and performance of the Building Rules, Regulations and Bye-laws for the time being of possession the concerned local authority and of Government and other public bodies. The Allottee shall also observe and perform all the stipulations and conditions laid down by the Maintenance In ChargeSociety/Association for ensuring safety Limited Company/Apex Body/Federation regarding the occupation and this is very much mandatory keeping the safety use of the Complex Apartment in the Building and shall pay and contribute regularly and punctually towards the taxes, expenses or other out-goings in accordance with the terms of this Agreement to the Association/Maintenance Agency , as the case may be.
(xxiii) The Allottee shall permit the Promoter/Association/Maintenance Agency, as the case may be, and their surveyors and agents, with or without workmen and others, at all reasonable times, to enter into and upon the said buildings or any part thereof to view and examine the state and condition thereof.
(xxiv) Nothing contained in this Agreement is intended to be nor shall be construed as a whole grant, demise or assignment in mindlaw, of the said Apartments or of the Schedule Land and Building or any part thereof. The Allottee shall have no claim save and except in respect of the Apartment hereby agreed to be sold to him and all open spaces, , lobbies, staircases, terraces recreation spaces , will remain the property of the Promoter until the Project is handed over to the Society/Association.
(xxv) For the purposes of this Agreement and the construction of the Said Project, the Allottee(s) hereby irrevocably authorizes/empowers the Promoter, to make necessary representations for and on behalf of the Allottee(s) before the concerned authorities, including the authorities of the Maharashtra Regional and Town Planning Act, 1966 / Municipal Corporation / Competent Authority for alteration, change, modification, revision, renewal and sanction of the plans for construction of the building/s, additional or otherwise, without prejudicially affecting the said Apartment being purchased by the Allottee(s).
(xxvi) The Allottee(s) hereby irrevocably consent/s and authorize/s the Promoter to represent him/her/them in all matters regarding property tax assessment and reassessment before the concerned Municipal Authorities and decisions taken by the Promoter in this regard shall be binding on the Allottee(s). The Promoter may till the execution of the Final Conveyance Deed represent the Allottee(s) and his/her/their interest and give consent, NOC's and do all the necessary things in all departments of Municipal Corporation, Collectorate, Road, Water, Building Tax Assessment departments, Government & Semi- Government, M.S.E.D.C.L., U.L.C. officials, etc. on behalf of the Allottee(s) and whatever acts so done by the Promoter on behalf of the Allottee(s) shall stand ratified and confirmed by the Allottee(s)

GENERAL COMPLIANCE WITH RESPECT TO THE UNIT. 16.1 15.1. Subject to Para clause 12 above, the Allottee shall, after taking possession, be solely responsible to maintain the Unit, Unit at his/ his/her own on cost, in good repair and condition including periodic painting of the exterior on all sides. It shall be the responsibility of the allottee to maintain his Complex in a proper manner and take all due care needed including but not limiting to the joints in the tiles in his unit are regularly filled with white cement/ epoxy to prevent water seepage and shall not do or suffer to be done anything in or to the buildingsaid project, or the Unit Unit, or the staircases, lifts, common passages, corridors, circulation areas, atrium or the compound which may be in violation of any laws or rules of any authority authorities or change or alter or make additions to the Unit and keep the Unit , its walls and Authorised Signatory partitions, sewers, drains, pipe and appurtenances thereto or belonging thereto, thereto in good and tenantable repair and maintain the same in a fit and proper condition and ensure that the support, shelter etc. of the Building is not in any way damaged or jeopardized and shall not cause any change to the colour, design of the elevation /exteriorjeopardized.
16.2 15.2. The Allottee further undertakes, assures and guarantees that he/ he/she would not put any sign board/ namesign-board/name plate, neon light, publicity material or advertisement material etc etc. on the face/ façade face and facade of the said project/Building or anywhere on the exterior of the said Project/whole project, building therein or common areasCommon Areas and Facilities.
15.3. The Allottees Allottee shall also not change the colour color scheme of the outer walls or painting of the exterior side of the doors/windows or carry out any change in the Lobby/exterior elevation or design.
15.4. Further Further, the Allottee shall not store any hazardous or combustible goods in the Unit, Unit or place any kind of thing, articles, goods or heavy material in the common passages passages, pavements, Streets, open compound or staircase of the buildingsaid project and the Promoter/ Maintenance Agency/Association of Allottees (AOA)shall be entitled to remove the same without giving any notice to the Allottee and to take them in its custody at the cost, risk and responsibility of the Allottee. The Promoter/Maintenance Agency / AOAshall have the authority to dispose off the same without any notice or accountability to Allottee and no claim of any sort whatsoever shall be made by the Allottee against the Promoter in respect of such goods/things. The Allottee shall also not remove any wall, including the outer and load bearing wall of the Unit, .
16.3 15.5. The Promoter shall not be liable for any liability (legal or others) arising in the event of the Allottee(s)relying on the marketing agency or any sale broker, marketing campaign, published material. It is agreed recorded that the sole responsibility of the Allottee(s) to confirm the information provided to them from the Promoter shall have exclusive right to place Hoarding, Neon Sign before relying on the stair head room and Lift Machine room and same.
15.6. The Allottee shall not do or suffer anything to be done in other or about the said unit which may tend to cause damages to any Common areas/walls and exteriorsArea/ roads/ passage in the unit(s) or in any manner interfere with the use thereof or of any open space, passage or amenities available for common use. ~
16.4 15.7. The Allottee shall plan and distribute its electrical load in conformity with the electrical systems installed by the promoter Promoter and thereafter the association Association of allottees and/ Allottees and / or maintenance agency appointed by association Association of allotteesAllottee. The Allottee shall be responsible for any loss or damage damages arising out of breach of any of the aforesaid conditionscondition.
15.8. Periodic test of Electrical installations The Allottee understands and agrees that all fIxture and fItting including wiring and also by Chartered Engineer air conditioners, coolers etc. shall be carried installed by him at the place earmarked or approved by the Promoter/Maintenance Agency/ Association of Allottees and nowhere else. Non-observance of the provisions of this clause shall entitle the Promoter or Maintenance Association/ Association of Allottees, as the case may be, to enter the Unit, if necessary and remove all non-conforming fittings & fixtures at the cost and expenses of the Allottee(s).
15.9. The Allottee understands and agrees that the said ownership rights in the Unit shall be sold to the Allottee only for the specifIed purpose of being used as residential flat subject to the specific condition that the Allottee shall have no right to use the Unit for the business, ,workshop, factory, bar, gambling house/lodging house, noisy, offensive, obnoxious, immoral or for any illegal purposes. The Allottee has further specifically agreed that he shall not himself use or permit any other person to use the Unit for the purpose other than that for which the Unit is being sold to him. In the case of violation of this condition, the Promoter/Maintenance Association / AOA shall be entitled to take steps to enforce the conditions laid down in this clause apart from their right to claim damages from the Allottee and the right to take such other action or seek such other legal remedy as the Promoter/Maintenance Association / AOAmay decide for restraining the Allottee from making a use prohibited by this Agreement.
15.10. The Allottee shall not use the said premises for any purpose, which mayor is likely to cause nuisance or annoyance to owners/occupants of other Units and/ or Common Area / Common Parts/ Facility in the said project/whole project.
15.11. The Allottee shall not do or suffer anything to be done in or about the said Unit which may tend to cause damages to any Common Area/ Roads/ Streets in the said project or in any manner interfere with the ror Xxxxxxx Build Developers Ltd. 32 ~ Authorised Signatory use thereof or of any open space, garden/park, passage or amenities available for common use.
15.12. The Allottee(s) shall not raise any construction whether temporary or permanent on the rear/front balcony/ lawns /roof-top/ terrace under his/her/its use.
15.13. Allottee(s) shall not throw dirt, rubbish, rags, garage etc. or permit the same to be thrown from the Unit in the compound or any portion of the Scheduled Land/project land and the Building in which the Unit is situated.
15.14. The Allottee shall not at any time demolish the structure of the said Unit or any part thereof and not make or cause to be made any additions or alterations of whatever nature to the said Unit or any part thereof. The Allottee may, however, make suitable changes in the said Unit and other internal alterations and additions as per the terms of this Agreement or the maintenance agreement, as the case may be, without causing damage or harm to the main structure as well as the ceiling of said Unit & architectural aspect thereof but only with the prior approval/consent of the Promoter/Maintenance Association / AOA in writing. Provided that if any such additions or alterations, require the prior approval or permission of any municipality or any other local body or government authority, the Allottee shall not carry out such additions or alterations or erections without obtaining the prior permission or complying with such rules and regulations of such Municipal or local body or Government Authority and getting such sanction / permission on payment of fee, tax, etc.
15.15. That the Allottee shall carry out day-to-day maintenance of the said Unit and fIxtures and fIttings installed therein including painting, polishing of interiors, electrical fIttings & maintenance, plumbing, sewer drainage, cleaning & maintenance of the said Unit at interval its own costs without affecting and disturbing other Unit holders.
15.16. The Allottee shall comply with and carryout all the required requisitions, demands and repairs which are required by any Development Authority / Municipal Authority / Government or any other Competent Authority including Maintenance Agency in respect of every 2 years the said Unit, at his own cost and also keep the Promoter indemnifIed, secured and harmless against all costs, consequences and all For Xxxxxxx Build Developers Ltd. 33 ~ Authorised Signatory damages, arising on account of non-compliance with the said requisitions, demands and repairs.
15.17. The Allottee agrees and undertakes that he/she shall join Association of Allottees as may be formed by the Promoter on behalf of the Unit holders and to pay any fees, subscription charges thereof and to complete such documentation and formalities as may be deemed necessary for this purpose.
15.18. It is in the interest of the Allottee(s),to help the Owners Association in effectively keeping the Unit and/or the Said Project/Whole project secured in all ways, For the purpose of security, the Owners Association would be free to restrict and regulate the entry of visitors into the Building/ Said Project/Whole project.
15.19. The Allottee(s) shall be liable to pay house-tax, property-tax, fire- fighting tax or any other fee, cess or tax as applicable under law, as and when levied by any local body or authority and so long as the Unit of the Allottee(s)is not separately assessed to such taxes, fees or cess, the same shall be paid by the Allottee(s) in proportion to the Carpet Area of Unit. If the Promoter/Maintenance Association / AOAhas to pay the aforesaid amounts on behalf of the Allottee(s), the Allottee(s) shall be liable to reimburse the same to the Promoter/Maintenance Association / AOAwithin 30 days from the date of notice in this regard from the Promoter/Maintenance Association / AOA,failing which the Promoter/ Maintenance Association / AOAshall be entitled to interest at the Interest Rate for the period commencing on the date on which the Promoter/Maintenance Association / AOApaid the said amounts to the concerned authorities and ending on the date on which the Allottee(s) pays the said amounts to the Promoter/Maintenance Association / AOA.Alltaxes charges, cesses, levies etc shall be payable by the Allottee even if such demand is raised by the Authorities retrospectively after possession and/ or conveyance of said Unit and at such demands shall be treated as unpaid consideration of said Unit and the time Promoter shall have first charge/ lien on said Unit for recovery of possession such demands from the Allottee.
15.20. The Allottee undertakes not to sub-divide the said Unit, agreed to be sold to him / her. The Allottee further undertakes that in case it transfers its right and interests in the said Unit, in favour of any person/promoter by way of sale, mortgage, tenancy, license, gift or in For ManglamBuildDevelopersLtd. 34 ~ Authorised Signatory any other manner, such person / promoter so inducted by the Maintenance In Charge/Association for ensuring safety Allottee shall also be bound by the terms and conditions of this is very much mandatory keeping the safety Agreement.
15.21. The Allotteeunderstands and agrees that each space of the Complex Project not separately assessed for municipal taxes etc. the Allottee shall pay proportionate share of the Municipal Taxes, Ground Rent, Land and Building Tax and other statutory taxes assessed on the said Project/Whole project. Such Taxes, Fees etc. shall be paid by Allottee in proportion to the Carpet Area. Such apportionment shall be made by the Promoter/Maintenance Agency/ AOA and the same shall be conclusive, final and binding upon the Allottee and the Allottee shall promptly pay such proportionate amount of tax.
15.22. The Allottee agrees that if at any time under any law/order or if the Promoter/Maintenance Agency/AOAmay think necessary to insure the title of the land/ Building / Unit /Project/Whole project, the charges towards the same shall be paid by the Allottee proportionately as may be demanded by the Promoter/Maintenance Agency/AOAin future.
15.23. In case the Allottee wants to avail a whole in mindloan facility from any financial institution/Bank to facilitate the purchase of the Unit applied for, the Promoter shall facilitate the process subject to the following:
1. Any financing agreement between Financing Institution/Bank and the Allottee shall be entered into by the Allottee at its sole cost, expense, liability, risk and consequences.

It shall be the responsibility of the allottee to maintain his Complex in a proper manner and take all due care needed including but not limiting to the joints in the tiles in his unit are regularly filled with white cement/ epoxy to prevent water seepage and shall not do or suffer to be done anything in or to the buildingUnit, or the Unit or the staircases, lifts, common passages, corridors, circulation areas, atrium or the compound which may be in violation of any laws or rules of any authority or change or alter or make additions to the Unit Unit, and keep the Unit Unit, its walls and partitions, sewers, drains, pipe pipes and appurtenances thereto or belonging thereto, thereto in good and tenantable condition and repair and maintain the same in a fit and proper condition and ensure that the support, shelter etc. of the Building is not in any way damaged or jeopardized and shall not cause any change to the colour, design of the elevation /exteriorjeopardized.
16.2 (ii) The Allottee Allottee(s) further undertakes, assures and guarantees that he/ she would not put any sign sign-board/ name-plate, neon light, publicity material or advertisement material etc etc. on the face/ façade of the Building or anywhere on the exterior of the projectSaid Project/Whole Project, building therein or common areas. .
(iii) The Allottees Allottee(s) shall also not change the colour color scheme of the outer walls wall or painting of the exterior side of the doors/windows or carry out any change in the Lobby/exterior elevation or design. .
(iv) Further the Allottee Allottee(s) shall not store any hazardous or combustible goods in the Unit, Unit or place any heavy material in the common passages or staircase of the buildingBuilding. The Allottee Allottee(s) shall also not remove any wall, including the outer and load bearing wall of the Unit, .
16.3 It is agreed recorded that the Promoter (v) That all fixture and fitting including but limited to air conditioners, coolers etc. shall have exclusive right to place Hoarding, Neon Sign on the stair head room and Lift Machine room and in other Common areas/walls and exteriors
16.4 The Allottee shall plan and distribute its electrical load in conformity with the electrical systems be installed by the promoter Allottee(s) at place earmarked or approved by the Promoter/ Owners Association and thereafter the association of allottees and/ or maintenance agency appointed by association of allotteesnowhere else. The Allottee non-observance of the provisions of this clause shall entitle the Promoter or Owners Association, as the case may be, to enter the Unit, if necessary and remove all non-conforming fittings & fixtures at the cost and expenses of the Allottee(s).
(vi) The Allottee(s) agrees to abide by and comply with the bye-laws or housing rules or such rules which may be responsible issued from time to time by the Owners Association in the interest of the upkeep, cleanliness, security, etiquettes and maintenance of the Said Project/Whole Project.
(vii) The Allottee(s) shall not raise any construction whether temporary or permanent on the rear/front balcony/ lawns /roof-top/ terrace under his/her/its use.
(viii) It is in the interest of the Allottee(s), to help the Owners Association in effectively keeping the Unit and/or the Said Project/Whole Project secured in all ways, For the purpose of security, the Owners Association would be free to restrict and regulate the entry of visitors into the Building/ Said Project/Whole Project.
(ix) The Allottee(s) shall not use the Unit for any loss purpose other than as set out under this Agreement nor use the same for any purpose which may or damage arising out is likely to cause nuisance or annoyance to occupiers of breach the premises in the Said Project/Whole Project or for any illegal or immoral purpose.
(x) Allottee(s) shall not throw dirt, rubbish, rags, garage etc. or permit the same to be thrown from the Unit in the compound or any portion of any aforesaid conditions. Periodic test of Electrical installations including wiring the Scheduled Land and also by Chartered Engineer shall be carried out at interval of every 2 years and also after possession and at the time of possession Building in which the Unit is situated.
(xi) Allottee should adher to the signage specifications provided by the Maintenance In Charge/Promoter or the Association for ensuring safety and this is very much mandatory keeping the safety maintenance agency.
(xii) Allottee(s) shall not do or permit to be done any act or thing which may render void or voidable any insurance of the Complex as a whole Unit and the Building/Said Project/Whole Project in mindwhich the Unit is situated or lead to increase in insurance premium payable in respect of the insurance of the said Building/Said Project/Whole Project and/or the Unit.

9.3 The Allottees Allottee(s) shall also not change the colour color scheme of the outer walls wall or painting of the exterior side of windows or permit any remodeling, alteration, variation, change or build upon the doors/windows look, design, texture, fixtures, materials or any combination thereof or carry out any change in the Lobby/exterior elevation or design. design of the Unit / Building / Said Project / Residential Block / Whole Project.
9.4 Further the Allottee Allottee(s) shall not store any hazardous or combustible goods in the Unit, Unit or place any heavy material in the common passages or staircase of the buildingBuilding or any part of the Whole Project. The Allottee Allottee(s) shall also not remove any wall, including the outer and load bearing wall of the Unit, .
16.3 It is agreed recorded 9.5 That all fixture and fitting including but limited to air conditioners, coolers etc. shall be installed by the Allottee(s) at place earmarked or approved by the Promoter/ Association and nowhere else. The non-observance of the provisions of this clause shall entitle the Promoter or Association, as the case may be, to enter the Unit, if necessary and remove all non- conforming fittings & fixtures at the cost and expenses of the Allottee(s).
9.6 The Allottee(s) shall neither encroach upon the Common Areas of the Whole Project and or Common Areas, Amenities and Facilities of the Residential Block or Common Areas, Amenities and Facilities of the EWS and Convenient Shopping Block or the Nursery School Land or the Primary School Land or the Internal Access Road, as the case may be nor store any goods, objects, articles, belongings etc. in such areas or block the same in any manner whatsoever.
9.7 The Allottee(s) agrees to abide by and comply with the Bye-Laws or housing rules or such rules which may be issued from time to time by the Association in the interest of the upkeep, cleanliness, security, etiquettes and maintenance of the Building / Said Project/Whole Project.
9.8 The Allottee(s) agrees and acknowledges that the Promoter shall have exclusive reserves the right to place Hoardingname/rename/brand the Whole Project / Said Project and its components; and the Allottee(s) shall not have any objections to the same.
9.9 If any damage is caused to the Unit, Neon Sign including any part of he Said Project / Whole Project (including but not limited to Common Areas, Amenities and Facilities of the Whole Project or Common Areas, Amenities and Facilities of the Residential Block or Common Areas, Amenities and Facilities of the EWS and Convenient Shopping Block or the Nursery School Land or the Primary School Land or the Internal Access Road, as the case may be) and the machines and equipment installed therein, on account of any act, negligence or default on part of the Allottee(s) or his employees, agents, servants, guests, or invitees, the Allottee(s)shall be liable and responsible for the consequences thereof, including the obligation to pay for the rectification of loss and/ or damage caused as may be levied by the Promoter / Association / Maintenance Agency.
9.10 The Allottee(s) shall not raise any construction whether temporary or permanent on the stair head room rear/front balcony/ lawns /roof-top/ terrace under his/her/its use.

16.4 The Allottee the cost thereof shall plan and distribute its electrical load in conformity with be contributed by all the electrical systems installed by allottees / occupants of Building / Said Project / Whole Project, as part of the promoter and thereafter charges payable to the association of allottees and/ or maintenance agency appointed by association of allotteesMaintenance Agency. The Allottee Allottee(s) shall be responsible for the insurance of his Unit and its contents.
