Licenses for the Licensed Programs to which this OST applies may be granted according to one of the following licensing schemes (specifying the authorized use), as specified in the Product Portfolio if available, and as determined in the applicable Transaction Document: ⮚ Concurrent (or Floating) Based ⮚ Credit Based ⮚ Token Based Licenses for the Licensed Programs to which this OST applies are granted for use on Machines by the Users (and Extended Enterprise Users, as applicable) only in the country for which the 3DS Offerings are ordered. However, (i) Users, whose usual workplace is located in the same country as the country where such use of the Licensed Programs has been authorized, may use the Licensed Programs in any other country (subject inter alia to the export and re-export laws and regulations provisions of the Agreement) for purposes of a business trip of a maximum of thirty (30) consecutive days and (ii) 3DS may authorize, on a case-by-case basis, the use of certain Licensed Programs by the Users (and Extended Enterprise Users, as applicable) on a Remote Access mode. It is agreed that, notwithstanding anything to the contrary provided in the Documentation, software components packaged and delivered by 3DS as part of a given 3DS Offering: ⮚ shall solely be used together and as part of such 3DS Offering and ⮚ shall not be used standalone and/or for other purposes than the ones for which such 3DS Offering has been marketed and granted to Customer by 3DS. If a patent invention is implemented in the 3DS Offering for which a right to use or access is granted pursuant to the Agreement, 3DS hereby grants Customer a non-exclusive license on the applicable patent limited to the use of such 3DS Offering.

It is agreed that, notwithstanding anything to the contrary provided in the Documentation, software components packaged and delivered by 3DS as part of a given 3DS Offering: ⮚ shall solely be used together and as part of such 3DS Offering and ⮚ shall not be used standalone and/or for other purposes than the ones for which such 3DS Offering has been marketed and granted to Customer by 3DS. If a patent invention is implemented in the 3DS Offering for which a right to use or access is granted pursuant to the Agreement, 3DS hereby grants Customer a non-exclusive license on the applicable patent limited to the use of such 3DS Offering. Images, videos, and texts presenting 3DS Offerings functionalities and included as marketing materials in the Platform are not contractual. Customer shall only refer to the Documentation with respect to the 3DS Offerings functionalities.

DS Offerings are provided for a maximum number of users of such dashboards, equal to the number of Named-Users and Extended Enterprise Named Users, as applicable, for which Customer has purchased rights to access such DS Offerings. It is agreed that, notwithstanding anything to the contrary provided in the Documentation, software components packaged and delivered by 3DS DS as part of a given 3DS DS Offering: ⮚ shall solely be used together and as part of such 3DS DS Offering and ⮚ shall not be used standalone and/or for other purposes than the ones for which such 3DS DS Offering has been marketed and granted to Customer by 3DSDS. The Customer must reactivate each license of the 3DS Offering, (i) one (1) year after the initial activation of the license, (ii) one (1) year after each subsequent reactivation of the license and (iii) at all one (1) year intervals thereafter. In the event the activation of any of these licenses expires and is not reactivated, the activation and the use of the 3DS Offering will cease and will not be operational until reactivation. This does not affect the perpetual license right to use granted under the PLC pricing structure.

If a patent invention is implemented in the 3DS DS Offering for which a right to use or access is granted pursuant to the Agreement, 3DS DS hereby grants Customer a non-exclusive license on the applicable patent limited to the use of such 3DS DS Offering.

General Rules. Licenses for the Licensed Programs to which this OST applies may be granted according to one of the following licensing schemes (specifying the authorized use), as specified in the Product Portfolio if available, and as determined in the applicable Transaction Document: ⮚ Concurrent (or Floating) Based ⮚ Credit Based ⮚ Token Machine (or node-lock) Based Licenses for the Licensed Programs to which this OST applies are granted for use on Machines by the Users (and Extended Enterprise Users, as applicable) only at the Site(s) and in the country for which the 3DS Offerings are ordered. However, (i) Users, whose usual workplace is located in the same country as the country where such use of the Licensed Programs has been authorized, may use the Licensed Programs in any other country (subject inter alia to the export and re-export laws and regulations provisions of the Agreement) for purposes of a business trip of a maximum of thirty (30) consecutive days and (ii) 3DS may authorize, on a case-by-case basis, the use of certain Licensed Programs by the Users (and Extended Enterprise Users, as applicable) on a Remote Access mode. Any Concurrent (or Floating) Based Licensed Program may be licensed for Multi-Site usage if so authorized by 3DS and subject to additional fees, and Customer may install and use those Licensed Programs on Machines located in several Customer’s facilities, as specified in the Transaction Document. It is agreed that, notwithstanding anything to the contrary provided in the Documentation, software components packaged and delivered by 3DS as part of a given 3DS Offering: ⮚ shall solely be used together and as part of such 3DS Offering and ⮚ shall not be used standalone and/or for other purposes than the ones for which such 3DS Offering has been marketed and granted to Customer by 3DS. Licenses for the Licensed Programs Online Services to which this OST applies may be granted according to one of the following licensing schemes (specifying the authorized use), as specified in the Product Portfolio if available, and as determined in the applicable Transaction Document: ⮚ Concurrent ( Named User Based either for Subscriber User, Analyst User or Floating) Based ⮚ Credit Based ⮚ Token Based Licenses for the Licensed Programs Publisher User System License Online Services to which this OST applies are granted for use on Machines by the Users (and Extended Enterprise Users, as applicable) only in the country for which the 3DS DS Offerings are ordered. However, subject to the availability of access to the Online Services in the countries specified in the Service Level Agreement (i) Users, whose usual workplace is located in the same country as the country where such use of the Licensed Programs Online Services has been authorized, may use the Licensed Programs Online Services in any other country (subject inter alia to the export and re-export laws and regulations provisions of the Agreement) for purposes of a business trip of a maximum of thirty (30) consecutive days and (ii) 3DS DS may authorize, on a case-by-case basis, the use of certain Licensed Programs Online Services by the Users (and Extended Enterprise Users, as applicable) on a Remote Access mode. Each Online Services Named-User Based must be assigned to a specific Named User or a specific Extended Enterprise Named User as applicable, for a minimum duration of thirty (30) days even if the user’s access to the Online Services is removed during this period. Online Services authorize creation of dashboards which are administered by Customer. Online Services are provided for a maximum number of users of such dashboards, equal to the number of Named-Users and Extended Enterprise Named Users, as applicable, for which Customer has purchased rights to access such Online Services. It is agreed that, notwithstanding anything to the contrary provided in the Documentation, software components packaged and delivered by 3DS DS as part of a given 3DS DS Offering: ⮚ shall solely be used together and as part of such 3DS DS Offering and ⮚ shall not be used standalone and/or for other purposes than the ones for which such 3DS DS Offering has been marketed and granted to Customer by 3DSDS. If a patent invention is implemented in the 3DS DS Offering for which a right to use or access is granted pursuant to the Agreement, 3DS DS hereby grants Customer a non-exclusive license on the applicable patent limited to the use of such 3DS DS Offering.
