Common use of General Use and Disclosure Provisions Clause in Contracts

General Use and Disclosure Provisions. Except as otherwise limited in this Agreement, Business Associate may use or disclose Protected Health Information in connection with its performance of the services under the Services Agreement if such use or disclosure of Protected Health Information would not violate HIPAA, the HIPAA Privacy Regulations or the HITECH Standards if done by Covered Entity or such use or disclosure is expressly permitted under Section 3.b (“Specific Use and Disclosure Provisions”) of this Agreement.

Except as otherwise limited in this Agreement, Business Associate may use or disclose Protected Health Information on behalf of, or to provide services to, Covered Entity in connection with its the performance of the services under the Services Agreement if such use or disclosure of Protected Health Information would not violate HIPAA, the HIPAA Privacy Regulations or the HITECH Standards if done by Covered Entity or such use or disclosure is expressly permitted under Section 3.b (“Specific Use and Disclosure Provisions”) 4.b. of this Agreement.

(“Specific Use and Disclosure Provisions”) of this Agreement.

General Use and Disclosure Provisions. Except as otherwise limited in this Agreement, Business Associate may use or disclose Protected Health Information in connection with its performance for the proper management and administration of the services under Business Associate or to carry out the Services Agreement legal responsibilities of the Business Associate, if such use or disclosure of Protected Health Information would not violate HIPAA, the HIPAA Privacy Regulations Rule or the HITECH Standards if done by Covered Entity or such use or disclosure is expressly permitted under Section 3.b (“Specific Use and Disclosure Provisions”) of this AgreementHIPAA Security Rule.
