Global Safeguard Measures. Each Party retains its rights and obligations under Article XIX of the GATT 1994 and the WTO Agreement on Safeguards. In taking measures under these WTO provisions, a Party shall, consistent with WTO law and jurisprudence and in accordance with its domestic legislation, exclude imports of an originating product from one or several Parties if such imports do not in and of themselves cause or threaten to cause serious injury.

2. Actions taken pursuant to Article XIX of GATT 1994 and the Safeguards Agreement shall not be subject to Chapter X (Dispute Settlement) of this Agreement.

Global Safeguard Measures. 1. A Party taking any measure pursuant to Article XIX of GATT 1994 and the Safeguards Agreement may exclude imports of an originating good from the other Party from the action if such imports are non-injurious.
2. A Party shall advise the relevant contact point of the other Party of any safeguard action on initiation of an investigation and the reasons for it.

A Party shall not apply a safeguard measure or provisional measure, as provided in Article 7.10 (Scope and Duration of Safeguard Measures) or Article 7.11 (Provisional Safeguard Measures) on a good that is subject to a global safeguard measure, nor shall a Party continue the imposition of a safeguard measure or provisional measure on a good that becomes subject to a global safeguard measure.
3. A Party considering the imposition of a global safeguard measure on an originating good of the other Party shall initiate consultations with that Party as far in advance of taking such measure as practicable.

2. Neither Party shall apply, with respect to the same good, at the same time: (a) a safeguard measure; and (b) a measure under Article XIX of GATT 1994 and the Safeguards Agreement.
3. The provisions of this Article shall not be subject to Chapter 20 (Dispute Settlement), except for paragraph 2.
Global Safeguard Measures. Nothing in this Agreement shall affect the rights and obligations of WTO Members under Article XIX of GATT 1994 and the Agreement on Safeguards.
