Common use of GOODS AND SERVICES TAX REMISSION Clause in Contracts

GOODS AND SERVICES TAX REMISSION. (a) Canada agrees to obtain on behalf of the Band a remission order respecting the tax otherwise payable pursuant to Part IX of the Excise Tax Act, R.S.C. 1985, c. E-15 ("Goods and Services Tax"), as the same relates to the purchase price incurred in acquiring Entitlement Lands, Minerals or Improvements up to, but not exceeding, the Band's Equity Quantum. (b) Canada further agrees that, pursuant to the Technical Information Bulletin issued by the Department of National Revenue, Customs and Excise, regarding the Goods and Services Tax ("GST") Administrative Policy applicable to Indians (known as B-039R dated November 23, 1993) Acquisition Costs such as accounting, legal, consulting, appraisal and other related costs associated with the acquisition of real property by the Band are relieved of the GST and shall be exempt for purposes of this Agreement.
