Government, Authority and Commission Undertakings and Acknowledgements. (a) Where the performance of any obligation expressed to be an obligation of the Government under or pursuant to this Agreement is an obligation which the Commission is capable of performing under the authority validly granted to it (whether pursuant to any Law, by any other Government Entity or otherwise), the Commission undertakes to perform each such obligation in accordance with the provisions of this Agreement as if such obligation were expressed in this Agreement to be an obligation of the Commission.
