Common use of GOVERNMENT REQUISITION Clause in Contracts

GOVERNMENT REQUISITION. If the Aircraft, Airframe or any Engine is requisitioned for use by any Government Entity, LESSEE will promptly notify LESSOR of such requisition. All of LESSEE's obligations hereunder will continue as if such requisition had not occurred. So long as no Event of Default has occurred and is continuing, all payments received by LESSOR or LESSEE from such Government Entity will be paid over to or retained by LESSEE. If an Event of Default has occurred and is continuing, all payments received by LESSEE or LESSOR from such Government Entity may be used by LESSOR to satisfy any obligations owing by LESSEE.

GOVERNMENT REQUISITION. If the Aircraft, Airframe or Airframe, any Engine or the APU is requisitioned for use by any Government Entity, LESSEE will promptly notify LESSOR of such requisition. All of LESSEE's obligations hereunder will continue as if such requisition had not occurred. So long as no Default or Event of Default has occurred and is continuing, all payments received by LESSOR or LESSEE from such Government Entity will be paid over to or retained by LESSEE. If an a Default or Event of Default has occurred and is continuing, all payments received by LESSEE or LESSOR from such Government Entity may be used by LESSOR to satisfy any obligations due and owing by LESSEE.

If the Aircraft, Airframe or any Engine is requisitioned for use by any Government EntityGovernmental Body, LESSEE and such requisition does not constitute a Total Loss, Lessee will promptly notify LESSOR Lessor of such requisition. All of LESSEELessee's obligations hereunder will continue as if such requisition had not occurredoccurred (other than any of Lessee’s obligations the performance of which is rendered impossible solely as a result of the requisition). So long as no Event of Default has occurred and is continuingSubject to Section 19.10, all payments received by LESSOR Lessor or LESSEE Lessee from such Government Entity Governmental Body will be paid over to or retained by LESSEELessee. If an Event of Default has occurred and is continuing, all payments received by LESSEE or LESSOR Lessor from such Government Entity Governmental Body may be used by LESSOR Lessor to satisfy any obligations owing by LESSEELessee.
