Common use of Governmental Access to Records Clause in Contracts

Governmental Access to Records. Business Associate shall make its internal practices, books and records relating to the Use and Disclosure of PHI available to the Secretary for purposes of determining Covered Entity’s compliance with the Applicable Law. Except to the extent prohibited by law, Business Associate agrees to notify Covered Entity of all requests served upon Business Associate for information or documentation by or on behalf of the Secretary. Business Associate shall provide to Covered Entity a copy of any PHI that Business Associate provides to the Secretary concurrently with providing such PHI to the Secretary.

Governmental Access to Records. Business Associate shall make PHI and its facilities, internal practices, books books, records, accounts, and records other information relating to the Use use and Disclosure disclosure of PHI available to the Secretary for purposes of determining in a time and manner designated by the Secretary and shall cooperate with the Secretary concerning any investigation designed to determine Covered Entity’s 's or Business Associate's compliance with the Applicable Law. Except to the extent prohibited by law, Business Associate agrees to notify Covered Entity of all requests served upon Business Associate for information or documentation by or on behalf of the Secretary. Business Associate shall provide to Covered Entity a copy of any PHI that Business Associate provides to the Secretary concurrently with providing such PHI to the SecretaryHIPAA.

Except to the extent prohibited by law, Business Associate agrees to notify Covered Entity of all requests served upon Business Associate for information or documentation by or on behalf of the SecretaryPrivacy Rule [45 C.F.R. Section 165.504(e)(2)(ii)(I). Business Associate shall concurrently provide to Covered Entity a copy of any internal practices, books, and records relating the use and disclosure of PHI that Business Associate provides to the Secretary concurrently with providing such PHI to the Secretary.

Business Associate shall make its internal practices, books and records relating to the Use use and Disclosure disclosure of PHI received from, or created or received by Business Associate on behalf of, Covered Entity available to the Secretary for purposes of the Secretary determining whether Covered Entity or Business Associate has complied with the HIPAA Rules, at the request of the Covered Entity and at a time and in a manner designated by the Covered Entity’s compliance with the Applicable Law. Except to the extent prohibited by law, Business Associate agrees to notify Covered Entity of all requests served upon Business Associate for information or documentation by or on behalf of the Secretary. Business Associate shall concurrently provide to the Covered Entity a copy of any PHI PHI, policies and procedures or other documentation that Business Associate provides to the Secretary concurrently with providing such PHI to the Secretary.
