Grant of Crossing. Effective as of the date of Questar Gas’s payment of the agreed- upon compensation, MWDSLS hereby grants Questar Gas a non-exclusive crossing for the Maintenance and Surface Inspection of Feeder Line 6 that is forty (40) feet in width with respect to the Non-Corridor Property and twenty (20) feet in width and not more than 14.64 inches deeper than the location of the outside of Feeder Line 6 with respect to the Corridor Property, as depicted in Exhibit B (the Crossing). The legal description of the location and width of the Crossing is included in Exhibit B. MWDSLS hereby also grants to Questar Gas the right of reasonable ingress and egress to and from the Crossing across the Two Parcels for Maintenance and Surface Inspection of Feeder Line 6 pursuant to Sections 3.1 and 3.2, below. The route or routes to be used for such ingress and egress shall be reasonably designated by MWDSLS and may be reasonably modified by MWDSLS from time to time as conditions may change. All rights granted by MWDSLS to Questar in this Agreement are subject to and subordinate to contracts between Third Parties and MWDSLS and conveyances by MWDSLS existing as of the date of this Agreement.

  • SECTION 109 OF THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 The Contractor shall comply with the provisions of Section 109 of the Housing and Community Development Act of 1974. No person in the United States shall on the grounds of race, color, national origin, or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under this title. Section 109 further provides that discrimination on the basis of age under the Age Discrimination Act of 1975 or with respect to an otherwise qualified handicapped individual as provided in Section 504 of the Rehabilitation Act of 1973, as amended, is prohibited.
