THE ACADEMY. 2.1 The Company will establish and maintain, and carry on or provide for the carrying on of the Academy in accordance with the Master Agreement and this Agreement.
2.2 The curriculum provided by the Academy to pupils up to the age of 16 shall be broad and balanced.
2.3 The requirements for the admission of pupils to the Academy are set out at Annex 1.

THE ACADEMY. 1. A This Agreement made between the Secretary of State for Education and PROSPER Learning Trust is supplemental to the master funding agreement made between the same parties and dated 20 December 2017 as amended by a deed of variation dated 26th March 2019 (the “Master Agreement”).
THE ACADEMY. 2.1 The Company will establish and maintain, and carry on or provide for the carrying on of the Academy in accordance with the Master Agreement and this Agreement.
2.2 The Company must ensure special educational provision is made at the Academy for one or more categories of SEN. The primary category of SEN will be ASD and may include, but is not limited to BESD.
2.3 The Company may not refuse to admit a child whose statement of SEN names one of the Special Free Schools on the sole basis that some, or all, of the child’s SEN do not feature in the categories referred to in clause 2.2 of this agreement.
