Grid Operator Protocols. The parties agree that Project Owner will be subject to and required to comply with the protocols of the grid operator and that such protocols will control how quickly Project Owner can curtail and resume its generation of power.

The parties agree that Project Owner will be subject to and required to comply with the protocols of the grid operator and that such protocols will control how quickly Project Owner can curtail and resume its generation of power, except that curtailment for National Security or Defense Purpose has precedence over grid protocols. The Project Owner shall disclose this curtailment requirement to the grid operator and shall attempt to the maximum extent practical to comply with the mitigation agreement’s curtailment provisions, including requesting waivers from the grid operator if grid protocols would interfere with this mitigation agreement.
