Guarantors’ Obligations Independent. The obligations of each Guarantor hereunder are as set forth in this Agreement and are independent of the obligation of any other Guarantor or any other Obligor, and a separate action or actions may be brought and prosecuted against any Guarantor whether or not any action is brought against any other Guarantor or any other Obligor and whether or not any other Guarantor or any other Obligor is joined in any such action.

Guarantors’ Obligations Independent. Guarantor’s obligations under this Guaranty are independent of those of any Market Participant. Guarantor’s obligations under this Guaranty are also several and independent of any other guarantees in effect with respect to any part of the above obligations and may be enforced regardless of the existence of any other guarantees. The ISO may bring an action against Guarantor without first proceeding against any Market Participant or any other person or security held by or for the benefit of a Market Participant and without pursuing any other remedy. The ISO’s rights under this Guaranty will not be exhausted by any action of the ISO until all of the Obligations have been fully paid and performed. RIGHTS OF SUBROGATION. Guarantor will have no right of subrogation with respect to any payments it makes under this Guaranty until all of the Obligations of the Market Participant are paid in full.
Guarantors’ Obligations Independent. Guarantor’s obligations hereunder shall be primary and this Guaranty shall be enforceable against Guarantor and its successors without the necessity for any suit or proceeding of any kind or nature whatsoever brought by Buyer against Seller, Seller’s successors or assigns or any other party, or against any security for the Guaranteed Obligation.
