Common use of Heirs and Assignees Clause in Contracts

Heirs and Assignees. a. All rights and liabilities herein given to, or imposed upon, the respective parties hereto shall extend to and bind the several and respective heirs, executors, administrators, successors and assigns of said parties; and if there shall be more than one Lessee, they shall all be bound jointly and severally by the terms, covenants and agreements herein, and the word “Lessee” shall be deemed and taken to mean each and every person or party mentioned as a Lessee herein, be the same one or more; and if there shall be more than one Lessee, any notice required or permitted by the terms of this Lease may be given by or to any one thereof, and shall have the same force and effect as if given by or to all thereof. Xxxxxx agrees that in the event Lessor files for protection under the Federal Bankruptcy Code or any similar law hereafter enacted having the same general purpose (the “Code”) Lessor agrees that in the event it rejects this Lease pursuant to and subject to the provisions of the Code that it shall not thereafter seek to convey its fee simple interest in the Demised Premises free and clear of Lessee’s possessory rights hereunder.

All rights and liabilities herein given to, or imposed upon, the respective parties hereto shall extend to and bind the several and respective heirs, executors, administrators, successors and assigns of said parties; and if there shall be more than one LesseeTenant, they shall all be bound jointly and severally by the terms, covenants and agreements herein, and the word “Lessee” "Tenant" shall be deemed and taken to mean each and every person or party mentioned as a Lessee Tenant herein, be the same one or more; and if there shall be more than one LesseeTenant, any notice required or permitted by the terms of this Lease may be given by or to any one thereof, and shall have the same force and effect as if given by or to all thereof. The words “words, "his” " and “"him” " or "its" wherever stated herein, shall be deemed to refer to the “Lessor” "Landlord" or “Lessee” "Tenant" whether such Lessor Landlord or Lessee Tenant be singular or plural and irrespective of gender. No rights, however, shall inure to the benefit of any assignee of Lessee Tenant unless the assignment to such assignee was permitted pursuant to Paragraph 14 above or has been approved by Lessor Landlord in writing as pursuant to Paragraph 14aforesaid. x. Xxxxxx agrees that in the event Lessor files for protection under the Federal Bankruptcy Code or any similar law hereafter enacted having the same general purpose (the “Code”) Lessor agrees that in the event it rejects this Lease pursuant to and subject to the provisions of the Code that it shall not thereafter seek to convey its fee simple interest in the Demised Premises free and clear of Lessee’s possessory rights hereunder.
