HIPAA Requirements. ‌ A. The ACO acknowledges that it is a covered entity or a business associate, as those terms are defined in 45 CFR § 160.103, of Participant Providers or Preferred Providers who are covered entities. B. The ACO shall have all appropriate administrative, technical, and physical safeguards in place before the Start Date to protect the privacy and security of protected health information (“PHI”) in accordance with 45 CFR § 164.530(c).
