Common use of Hire of Equipment Clause in Contracts

Hire of Equipment. The OWNER has agreed to hire the EQUIPMENT and provide any ADDITIONAL SERVICES to the HIRER on the terms and conditions as set out herein. Notwithstanding the aforegoing, if, for whatever reason, the HIRE CONTRACT is not signed prior to commencement of the proposed HIRE PERIOD, the Company by accepting the EQUIPMENT nonetheless unconditionally agrees, or shall be deemed to unconditionally agree, by conduct and is bound to the provisions and conditions of such agreement as fully as if such Agreement had been signed.
