Common use of Holdbacks, Holdback Release and Set Clause in Contracts

Holdbacks, Holdback Release and Set. Off Holdbacks and holdback releases will be determined by the Province according to sections 5.16, 5.17 and 8.4 of the DBFM Agreement. Any set-off by the Province pursuant to sections 9.2, 9.7, and 11.5 of the DBFM Agreement will be determined by the Province in accordance with the DBFM Agreement and may be applied against the Payment to the Contractor.

Holdbacks, Holdback Release and Set. Off Holdbacks and holdback releases will be determined by the Province according to sections 5.16, 5.17 and 8.4 of the DBFM DBFO Agreement. Any set-off by the Province pursuant to sections 5.18, 9.2, 9.79.8, and 11.5 of the DBFM DBFO Agreement will be determined by the Province in accordance with the DBFM DBFO Agreement and may be applied against the Payment to the Contractor.
