Common use of I HEREBY ACKNOWLEDGE AND AGREE THAT Clause in Contracts

I HEREBY ACKNOWLEDGE AND AGREE THAT. Speed Skating may be dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of Speed Skating itself, others which result from human error and negligence on the part of the persons involved in organizing, staging and/or operating the Western Elite Circuit #2; • as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, even death, as well as property loss; • some of the aforesaid risks and hazards are foreseeable, but others are not; • I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in Western Elite Circuit #2 shall be entirely at my own risk; • I understand that neither BCSSA nor any of its directors, officers, employees, sponsors, independent contractors or agents assume any responsibility whatsoever for my safety during the course of my preparation for or participation in Western Elite Circuit #2 • I have carefully read this RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT (the "Agreement"), that I fully understand same, and that I am freely and voluntarily executing same; • I clearly understand that by signing this Agreement I will be FOREVER PREVENTED FROM SUING OR OTHERWISE CLAIMING against BCSSA its directors, officers, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for Western Elite Circuit #2 whether or not such loss or injury is caused solely or partly by the negligence of BCSSA or any of its directors, officers, employees, sponsors, independent contractors and/or agents; • I have been given the opportunity and have been encouraged to seek legal advice prior to signing this Agreement;

I HEREBY ACKNOWLEDGE AND AGREE THAT. Speed Skating  COVID-19 has been declared a global pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to- person contact;  There is a risk of exposure to or infection by COVID-19 while using the Facilities, despite any COVID-19 safety protocols put in place by WVTC;  I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be dangerous, exposing participants exposed to many risks or infected by COVID-19 by using the Facilities and hazards, some of which are inherent that such exposure or infection may result in the very nature of Speed Skating itself, others which result from human error and negligence on the part of the persons involved in organizing, staging and/or operating the Western Elite Circuit #2; • as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, even deathillness, as well as permanent disability, death or property loss; • some  I understand that neither WVTC nor any of its directors, officers, employees, sponsors, independent contractors or agents represent or warrant that the aforesaid risks Facilities are free of COVID-19 or any disease or illness related to COVID-19.  I understand that the risk of becoming exposed to or infected by COVID-19 by using the Facilities may result from the actions, omissions, or negligence of myself and hazards are foreseeableothers, including, but others are notnot limited to, WVTC and its directors, officers, employees, sponsors, independent contractors or agents; •  I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in Western Elite Circuit #2 use of the Facilities shall be entirely at my own risk; • I understand that neither BCSSA nor any of its directors, officers, employees, sponsors, independent contractors or agents assume any responsibility whatsoever for my safety during the course of my preparation for or participation in Western Elite Circuit #2 •  I have carefully read this RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT (the "Agreement"), that I fully understand same, and that I am freely and voluntarily executing same; •  I clearly understand that by signing this Agreement I will be FOREVER F OREVER PREVENTED FROM SUING OR OTHERWISE CLAIMING against BCSSA WVTC, its directors, officers, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for Western Elite Circuit #2 from my use of the Facilities, whether or not such loss or injury is caused solely or partly by the negligence of BCSSA WVTC or any of its directors, officers, employees, sponsors, independent contractors and/or agents; •  I have been given the opportunity and have been encouraged to seek legal advice prior to signing this Agreement;;  I clearly understand that WVTC would not permit me to use the Facilities unless I signed this Agreement, that this Agreement applies to the use of the Facilities whether occurring in the near or distant future, and that the terms of this Agreement have been explained to me by WVTC or one or more of their representatives;  This Agreement is binding on myself, my heirs, my executors, administrators, personal representatives and assigns; and  This Agreement may be in addition to another agreement I must sign as a condition of my use of the Facilities and that I am bound by the terms and conditions of both agreements. Speed Skating Squash may be dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of Speed Skating squash itself, others which result from human error and negligence on the part of the persons involved in organizing, staging and/or operating the Western Elite Circuit #2squash league; • as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, even death, as well as property loss; • some of the aforesaid risks and hazards are foreseeable, but others are not; • I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in Western Elite Circuit #2 squash shall be entirely at my own risk; • I understand that neither BCSSA CVSC/the City nor any of its directors, officers, employees, sponsors, independent contractors or agents assume any responsibility whatsoever for my safety during the course of my preparation for or participation in Western Elite Circuit #2 squash • I have carefully read this RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT (the "Agreement"), that I fully understand same, and that I am freely and voluntarily executing same; • I clearly understand that by signing this Agreement I will be FOREVER PREVENTED FROM SUING OR OTHERWISE CLAIMING against BCSSA CVSC/the City, its directors, officers, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for Western Elite Circuit #2 squash, whether or not such loss or injury is caused solely or partly by the negligence of BCSSA CVSC/the City or any of its directors, officers, employees, sponsors, independent contractors and/or agents; • I have been given the opportunity and have been encouraged to seek legal advice prior to signing this Agreement;

Speed Skating  Softball may be dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of Speed Skating Softball itself, others which result from human hu- man error and negligence on the part of the persons involved in organizing, staging and/or operating the Western Elite Circuit #2Softball; •  as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal per- xxxxx injury, even death, as well as property loss; •  some of the aforesaid risks and hazards are foreseeable, but others are not; •  I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in Western Elite Circuit #2 Softball shall be entirely at my own risk; •  I understand that neither BCSSA SHSA and the VSL nor any of its directors, officers, employeesem- ployees, sponsors, independent contractors or agents assume any responsibility whatsoever whatso- ever for my safety during the course of my preparation for or participation in Western Elite Circuit #2 • Softball;  I have carefully read this RELEASE and WAIVER of LIABILITY AND ASSUMPTION ASSUMP- TION of RISK AGREEMENT (the "Agreement"), that I fully understand same, and that I am freely and voluntarily executing same; •  I clearly understand that by signing this Agreement I will be FOREVER PREVENTED FROM SUING OR OTHERWISE CLAIMING against BCSSA SHSA and the VSL, its directorsdi- rectors, officers, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for Western Elite Circuit #2 Softball, whether or not such loss or injury is caused solely or partly by the negligence of BCSSA SHSA and the VSL or any of its directors, officersoffic- ers, employees, sponsors, independent contractors and/or agents; •  I have been given the opportunity and have been encouraged to seek legal advice prior to signing this Agreement;
