Common use of ICS Clause in Contracts

ICS. The non-federal Parties agree that no Party or Contractor may claim as surplus under Article II.B.6 of the Consolidated Decree any DCP ICS created under the LBOps. Notwithstanding any contrary provisions in existing Lower Basin ICS agreements dated December 13, 2007; November 20, 2012; and September 21, 2017, ICS shall be available according to the terms and conditions of the LBOps.
