Common use of Identification of Equipment Clause in Contracts

Identification of Equipment. All Equipment which is or may become the Property of the Agency pursuant to the provisions of this Lease Agreement shall be properly identified by the Company by such appropriate records, including computerized records, as may be approved by the Agency. The Agency may request, and the Company shall deliver to the Agency within ten (10) days of such request, a schedule listing all such Equipment. All Property of whatever nature affixed or attached to the Land or used or to be used by the Company in connection with the Land or the Improvements shall be deemed presumptively to be owned by the Agency, rather than the Company, unless the same were installed by the Company and title thereto was retained by the Company as provided in Section 6.2 of this Lease Agreement and such Property was properly identified by such appropriate records as were approved by the Agency.

All Equipment which is or may become the Property property of the Agency pursuant to the provisions Bill of this Lease Agreement Sale shall be properly identified by the Company by such appropriate records, including computerized records, as may be approved by the AgencyAgency in its reasonable discretion. The Agency may request, and the Company shall deliver to the Agency within ten fifteen (1015) days of such request, a schedule listing all such Equipment. All Property Equipment of whatever nature affixed or attached to the Land or used or to be used by the Company in connection with the Land or the Improvements shall be deemed presumptively to be owned by the Agency, rather than the Company, unless the same were installed by the Company and title thereto was retained by the Company as provided in Section 6.2 of this Lease Agreement and such Property Equipment was properly identified by such appropriate records as were approved by the Agency.
