Common use of Immunity Clause in Contracts

Immunity. (a) The execution by it of each Finance Document to which it is a party constitutes, and the exercise by it of its rights and performance of its obligations under each such Finance Document will constitute, private and commercial acts performed for private and commercial purposes. (b) It will not be entitled to claim immunity from suit, execution, attachment or other legal process in any proceedings taken in its jurisdiction of incorporation in relation to any Finance Document.

Immunity. The Security Assets are not subject to any sovereign immunity defense by the Shareholder or the Borrower.

(b) It is generally subject to civil and commercial law and to legal proceedings and it cannot and will not be entitled able to claim for itself or its assets any immunity or privilege from suitany set-off, judgment, execution, attachment or other legal process in any proceedings taken in its jurisdiction of incorporation in relation to any Finance Documentprocess.
