Common use of Impact of Force Majeure on JPS Payments Clause in Contracts

Impact of Force Majeure on JPS Payments. During the pendency of Force Majeure the Company shall not be entitled to receive Fixed Payments or Variable Payments from JPS; provided that if the Force Majeure affects only part of the Facility, then the Fixed Payment during the pendency of such Force Majeure shall be pro-rated to reflect the portion of the Facility, not affected thereby, and the Company shall be entitled to receive such pro-rated Fixed Payments and Variable Payments for electrical energy actually delivered to JPS notwithstanding any unavailability of the Dependable Capacity.
