Common use of IMPASSE/MEDIATION Clause in Contracts

IMPASSE/MEDIATION. If by May 31, or such later date to which the representatives have agreed, accord is not reached on all items under discussion, the parties may declare impasse and request the Federal Mediation and Conciliation Service to appoint a mediator from its staff. The mediator shall meet with the parties or their representatives, not to exceed those members serving on the negotiating teams, either jointly or separately, and shall take such steps as he may deem appropriate to persuade the parties to resolve their differences and to effect a mutually acceptable agreement.
