Common use of Impositions and Other Indebtedness Clause in Contracts

Impositions and Other Indebtedness. Except for amounts being contested as provided in paragraph (b)(i) through (iii) of the definition of Permitted Exceptions, Borrower will pay and discharge, or cause to be paid and discharged (a) before delinquency all Impositions affecting it or the Collateral, (b) when due all lawful claims (including, without limitation, claims for labor, materials and supplies), which, if unpaid, might become a Lien or Encumbrance upon any of the Collateral, and (c) all its other Indebtedness, when due.

Except for amounts being contested as provided in paragraph clause (b)(i) through (iiib) of the definition of Permitted Exceptions, Borrower will pay and discharge, or cause to be paid and discharged discharge (ai) before delinquency all Impositions affecting it or the Collateral, its assets; (bii) when due all lawful claims (including, without limitation, claims for labor, materials materials, and supplies), which, if unpaid, might become a Lien or Encumbrance upon any of the Collateral, its assets; and (ciii) all its other Indebtedness, when due.
