IMPROVEMENTS AND SERVICES a. No later than one hundred twenty (120) days after the Commencement Date, Licensee will construct permanent fencing (the “Permanent Fencing”) on the boundary of the License Area. The Permanent Fencing must meet City of Glendale building code requirements, including containing a 36-inch opening for ingress and egress for the License Area. If a gate is included in the Permanent Fencing, the gate will comply with all exit hardware and Americans With Disabilities Act requirements. The Permanent Fencing must not block any exits to any adjacent buildings. Licensee will comply with all other relevant city and state laws and codes relating to its activity during the term of this Agreement. Aside from the Permanent Fencing, Licensee is not authorized to make any improvements or modifications to the License Area without prior written consent of the City, which the City may withhold for any reason. In conjunction with any request for the City’s consent to License Area improvement or modifications, Licensee will submit plans and specifications to the City for the City’s review. Upon termination of this Agreement, all improvements or modifications to the License Area, including Permanent Fencing, become the property of the City at no cost to the City. Any improvements or modifications to the License Area will require the Licensee to provide the City evidence of insurance that is acceptable to the City’s Risk Manager or then-equivalent position.
